Under the federal Fair Labor Standards Act (FLSA) employers are required to pay overtime pay of 1.5 times the regular rate to employees for any hours worked in excess of 40 per week. In addition, the plaintiffs claim that nursery workers were routinely required to put in hours of work without clocking in to receive payroll credit for the time.
