Employees Say Hamlin Nursery Ignored Overtime Laws

A class action lawsuit has been filed on behalf of employees of plant grower Hamlin Nursery & Company. The suit alleges that the nursery routinely denied overtime pay to employees who had worked hours in excess of 40 per week, and required them to put in hours "off the clock". The workers are seeking back overtime pay and other damages.

Hamlin Nursery & Company of Beaumont, Texas is alleged to have routinely denied overtime to employees of the company who had worked more than 40 hours in a given week. Under the federal Fair Labor Standards Act (FLSA) employers are required to pay overtime pay of 1.5 times the regular rate to employees for any hours worked in excess of 40 per week. In addition, the plaintiffs claim that nursery workers were routinely required to put in hours of work without clocking in to receive payroll credit for the time.

The workers seek back overtime pay plus liquidated damages for each worker included in the class.
