A class action has been filed against Mack Construction Services, Inc. (Mack) and its owners for allegedly violating the Fair Labor Standards Act (FLSA). The complaint alleges that the Company is subject to the provisions of the FLSA, knew that they must pay their employees overtime compensation, required employees to work overtime, but did not pay for overtime hours worked.
 
Attorneys for the Van Buren School District in Arkansas recently argued that a judge's decision granting class-action status in a lawsuit against the Van Buren School District should be overturned because there is no way to determine who would be in the class. The lawsuit was filed by former Van Buren teacher Steve Jones in 2003, claiming he was not compensated for some required non-instructional duty.
 
In 2004, nine african-american Water Services employees sued Metro alleging racially disparate pay, promotion, job assignments, supervision, discipline and accommodations. The lawsuit alleges former Water Services human resources manager Robin Brown, contributed to the problem by not being receptive to the employees’ concerns. Brown is now human resources manager at Metro’s Department of Human Resources. The 6th U.S. Circuit Court of Appeals has cleared the way for a group of Metro Water Services employees who sued the department for racial discrimination to proceed as a class action.
 
A statewide collective action has been filed in Florida against hotel giant, Fairfield Resorts, Inc. The action is brought on behalf of all current and former hourly employees of Fairfield Resorts, who since June 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
