Waffle House Employees Not Waffling Around About Denied Pay

A class action has been filed against Waffle House, Inc., a restaurant headquartered in Georgia, for violating the Fair Labor Standards Act (FLSA) by paying its wait staff for less time they actually worked and for not paying for overtime.

Specifically, the complaint alleges that Gayle Westfall is employed by Waffle House as a non-exempt employee and paid on an hourly basis. She alleges that Waffle House required her to train new employees, bus tables, wash dishes, clean bathrooms, floors and walls, assist customers, handle money and make trips to the bank on the Company’s behalf.

Westfall also alleges that she was required to stay on her shift for forty-five (45) minutes or more until relieved by a manager, but was not paid for that time. Westfall confronted Waffle House about this practice, was demoted and had her pay decreased. The class members seek unpaid back wages, other compensation due, and attorney’s fees and costs.

The employees have requested that the court issue notice to all potential class members.
 
Low wage laundry workers in San Leandro, California won a landmark lawsuit on September 23, 2005 when an Alameda County judge upheld their living wage claim against uniform giant, Cintas Corporation. The decision was the first class action living wage case decided by a U.S. court. It requires Cintas, the uniform rental giant, to pay more than $1 million in interest and back wages to 219 workers who washed and sorted uniforms, towels and mats between 1999 and 2003 at the Cincinnati-based company's San Leandro and Union City plants.
 
Texas law dictates that police officers get the same amount of vacation time as other public employees. The court has approved the parties' $90,000 settlement in a class action filed against the city of Fort Worth, Texas, on behalf of current and former police officers employed by the city between November 10, 1996, and November 10, 2000. Eligible officers should contact class counsel for information on how to take part in the settlement.
 
Decker College in Louisville, Kentucky, already under federal and state investigation, has been sued by a laid-off financial aid officer who says the school owes her $2,000 for work performed and benefits and who is seeking class-action status for her lawsuit.
 
Federal law protects workers from unexpected job losses due to surprise layoffs. A class action has been filed against the board of directors and certain top executives of now-bankrupt telecommunications provider Touch America, Inc., as well as former consultant Nightingale, LLC, of Stamford, Connecticut, on behalf of former Touch America employees who allege that they were not given sufficient notice before their layoffs, in violation of the federal Worker Adjustment and Retraining Notification (WARN) Act.
 
A class action lawsuit has been filed in federal court against Northwest Airlines. The case involves allegations of employment discrimination.
