Employees Claim Subway Plaza Ignored Overtime Laws

A class action lawsuit has been filed on behalf of employees of Florida based Subway Plaza Corporation. The suit alleges that the company routinely denied overtime pay to employees who had worked hours in excess of 40 per week. The workers are seeking back overtime pay and other damages.

Under the federal Fair Labor Standards Act (FLSA) employers are required to pay overtime pay of 1.5 times the regular rate to employees for hours in excess of 40 per week. The complaint alleges that Subway Plaza routinely failed or refused to pay employees overtime pay for hours worked above 40.

The workers seek back overtime pay plus a reasonable amount of liquidated damages for each plaintiff worker.

The 2002 lawsuit charged that the company had miscalculated the lump sum pension payment for participants in one of its pension plans. The plaintiffs claimed the method used to calculate the payments does not comply with federal law and resulted in underpayments.
 
The decision to reduce the number of federal airport security screeners has been an issue of great controversy. A class action has been filed against James M. Loy, in his capacity as administrator of the U.S. Transportation Security Administration, on behalf of older employees and union activists who allege that the administration is ignoring veterans' preference in its reduction-in-force decisions in violation of federal law and the U.S. Constitution.
 
According to Mark Curless, a resident of Cody, Wyoming and a former employee, Wal-Mart Stores Inc. has cheated him and other employess for time worked, including overtime hours. Mark Curless filed a lawsuit against the world's largest retailer because recently discovered memos show it has deleted thousands of hours of time worked from payroll records in a practice known as "time shaving," according to the complaint filed in U.S. District Court and assigned to Judge Alan Johnson in Cheyenne.
 
A class action lawsuit has been filed in United States District Court against Citigroup Global Markets, Inc. The case was originally filed in San Francisco Superior Court but has been moved to the federal court system at the request of the defendants. The case involves violations of federal labor law. A case management conference before the court has been scheduled for March 5, 2005. No additional information about the substance of the allegations is available at this time. A class action lawsuit has been filed in the Southern District Court of Florida against A Native Tree Service, Inc. The case involves violations of the Fair Labor Standards Act which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments.
