Sioux Valley Hospitals and Health System Sued by Uninsured Patients Who Complain of Over-Charging

A class action lawsuit has been filed on behalf of uninsured patients who received and were billed for medical care by any hospital within the South Dakota based Sioux Valley Hospitals and Health System network of hospitals. The suit contends that Sioux Valley billed its uninsured patients at rates far in excess of the rates employed for insured patients and that this practice was and is both discriminatory and illegal.

The complaint further states that Sioux Valley enjoys non profit status and the associated tax benefits but in fact is highly profitable, with gross assets of nearly half a billion dollars and net assets of a quarter billion dollars in 2003. The complaint further alleges that Sioux Valley’s collection practices are unreasonable and abusive.

Plaintiffs seek financial damages and injunctive relief, including the placement of all assets accrued by using unfair and deceptive practices into a constructive trust for the benefit of the plaintiffs. These assets are alleged to be in the hundreds of millions of dollars.

The parties have reached a tentative $3.5 million settlement in an action filed against David E. Tremoglie, the HMO that employed him, its malpractice insurer, and related companies. The action alleged that Mr. Tremoglie masqueraded as a psychiatrist in violation of state and federal medical licensing regulations. Persons who were treated by Mr. Tremoglie should contact the attorneys for the class as soon as possible, to be able to participate in the settlement.
 
Lipitor is the #1 prescribed cholesterol-lowering drug in the United States. A nationwide class action has been filed against pharmaceutical distributors Albers Medical, Inc., and Med-Pro, Inc. on behalf of consumers who allege that the companies repackaged and distributed counterfeit Lipitor and possibly other drugs as well. The action alleges that the companies violated the federal Racketeer Influenced Corrupt Organizations Act and the Missouri Merchandising Practices Act in distributing the counterfeit drugs.
 
A class action has been filed against Rapid City Regional Hospital, a hospital located in Rapid City, South Dakota for not providing charitable care to uninsured patients as required under their tax-exempt status. The class action has also been filed against the American Hospital Association, the national organization that represents and serves hospitals, health care networks, and their patients and communities for misleading the hospital on matters of charitable care.
