Providence Health System Sued by Uninsured Patients Who Complain of Over-Charging

A class action lawsuit has been filed on behalf of uninsured patients who received and were billed for medical care by any hospital within the Oregon based Providence Health Systems network of hospitals. The suit contends that Providence billed its uninsured patients at rates far in excess of the rates employed for insured patients and that this practice was and is both discriminatory and illegal.

The complaint further states that Providence enjoys non profit status and the associated tax benefits but in fact is highly profitable and paid its CEO over 1.4 million dollars in 2003.

Plaintiffs seek financial damages and injunctive relief from Providence, including the placement of all assets accrued using unfair and deceptive practices into a constructive trust for the benefit of the plaintiff. These assets are alleged to be in the hundreds of millions of dollars.

A class action has been filed against German drug manufacturer Bayer AG on behalf of employees of the Brentwood Post Office in Washington, D.C., and workers at the U.S. Capitol, along with employees of American Media, Inc. in Florida and postal workers in general, all of whom allege that they have suffered serious side effects from taking the antibiotic ciprofloxacin (Cipro) in the aftermath of the anthrax attacks in 2001. The action alleges that Bayer failed to warn them of the potential side effects in violation of the Pennsylvania Unfair Trade Practices and Consumer Protection Laws.
 
Kahn Gauthier Swick is investigating possible legal actions against Cordis Corporation on behalf of persons who have been injured by the company's Cypher coronary stent. On October 29, 2003, the federal Food and Drug Administration issued a warning that a significant number of adverse effects had been reported since the Cypher stent was approved on April 24. Both blood clotting and hypersensitivity reactions have been reported.
 
Kahn Gauthier Swick is investigating possible legal actions against nursing homes to recover for injuries suffered by nursing home residents. There are more than one and one-half million elderly and disabled persons in 17,000 nursing homes across the United States.
 
Corporate giants Pfizer and Microsoft have separately filed lawsuits against the operators of two web sites that send spam e-mails with offers for allegedly illegal generic versions of the erectile dysfunction medication Viagra . Both lawsuits accuse www.cndpharmacy.com and www.myepharmacydirect.com of violation of the company trademark and unfair competition.
 
A company is caught engaging in anticompetitive behavior, either state or federal antitrust law may be used against it. A class action has been filed against Medco Health Solutions, Inc. and Merck & Company on behalf of California pharmacists, who allege that the companies engaged in anticompetitive behavior in violation of state antitrust law.
 
In this day of incurable transmissible diseases, it would be nice to be confident that the needle that gets stuck in your arm has never been used before. On November 5, 2003, the court granted preliminary approval to the parties' $25 million proposed settlement in a class action filed against Oklahoma's Norman Regional Hospital, a clinic administrator, and nurse anesthetist James Hill who is accused of reusing needles when administering intravenous pain medicine to patients in the hospital's clinic in violation of state medical regulations.
