Gold Banc Charged Oklahoma Farmers Exurbanite Rates for Farm Loans |

A class action has been filed against Gold Banc Corporation, a Kansas bank doing business in western Oklahoma, by farmers who entered into loans with them and were charged high rates of interest on guaranteed loans by the Farm Service Agency (FSA). The class members seek compensation for interest paid, exemplary and punitive damages, and costs and attorney fees.
Specifically, the class members allege:
• Usury (charging unlawful rates of interest). Gold Banc charged the farmers interest rates that were sometimes four (4) percentage points higher than rates given to other customers • Conversion (wrongfully using another’s property), fraud, and fraud in the misappropriation of funds held in trust. The farmers allege that Gold Banc used the money for its own purposes. • Breach of fiduciary duty and breach of third party beneficiary contract. The farmers allege that Gold Banc did not follow the rules and regulations of the FSA, the Guaranteed Loan Program, or the contract • Charging excessive fees. The farmers allege that the Bank charged them additional monies that were allegedly unlawful, unconscionable, and disproportionate to the Bank’s other loan programs • Deceit

The action is brought on behalf of all Pennsylvania consumers who, since January 30, 2003, have received a "form type" collection letter from Bronson & Migliaccio. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief. A class action lawsuit has been filed against New York collection agent Law Offices of Mitchell N. Kay, PC. The suit alleges that the defendant engaged in abusive and deceptive collection practices that violated federal fair debt collection practices laws. The suit seeks to certify a national class and collect actual and punitive damages on behalf of the plaintiffs. A statewide class action has been filed in New York against collections specialist, Trans-Continental Credit & Collection Corporation. The action is brought on behalf of all New York residents who have received collection letters from Trans-Continental that contain language that consumers claim is deceptive, unfair and contains false threats. The action is brought under the federal Fair Debt Collections Practices Act and seeks statutory damages as well as injunctive and declaratory relief. A judge in California certified a class action lawsuit against Verisign to proceed and to include up to 400,000 class members. The total liability exposure to Verisign may exceed 200 million U.S. dollars. The suit was filed last year in California.
