Dry Cleaner takes it Own Employees to the Cleaners after Denying Them Overtime Pay

Report Fraud
Case ID: 3766 | Employment | 10/12/2004

A class action has been filed against Cadillac Cleaners, Inc., a dry cleaner in Texas, and Steve Miller alleging violations of the Fair Labor Standards Act (FLSA) by failing to pay their employees at time and one half their regular rates for hours worked in excess of forty (40) per week. The class members seek to recover unpaid overtime wages, as well as attorney’s fees and costs.

Specifically, the complaint alleges that Wilson was employed by Cadillac Cleaners as a non-exempt pants presser from September 23, 2000 to the present and paid $5.56 per hour. She worked 12 hours per day, 6 days per week, for a total of 72 hours per week. Instead of being paid her regular wages, Cadillac paid her a flat sum of $400 per week. She was never paid overtime for hours worked over 40 per week as required by the FLSA.
