Christus Southeast Hospital Sued for Collection Practices and Failing to Provide Lower Cost Care

A class action lawsuit has been filed in the Eastern District Court of Texas against Christus Southeast for violations of the Fair Debt Collection Practices Act (FDCPA) and for charging uninsured patients unreasonable costs compared to patients with insurance. Class members seek injunctive and declaratory relief as well as compensatory damages, attorneys’ fees and costs of the litigation.

Specifically, the complaint alleges that, as a charitable hospital, Christus has charged uninsured patient excessive fees for medical services, as compared to discounted rates charged to insured patients or individuals covered by federal programs such as Medicare and Medicaid. The suit also alleges the use of aggressive collection practices to obtain payment from uninsured patients and states that, as a non-profit hospital, Christus has an obligation to provide low cost care to patients without insurance.

In addition, the complaint alleges that Christus, along with other non-profit hospitals throughout the nation, have conspired to adopt the same practices. Similar lawsuits have been filed against other non-profit hospitals nationwide.

Kahn Gauthier Swick is investigating possible legal actions against Johnson and Johnson subsidiary McNeil-PPC, Inc., the maker of the popular over-the-counter painkiller Motrin, on behalf of Motrin users who have suffered a severe skin and mucus membrane reaction.
 
A class action has been filed against Dura Pharmaceuticals, Inc. (formerly Nasdaq: DURA) and certain of its officers and directors by stockholders who purchased the company's common stock between April 15, 1997, and February 24, 1998.
 
The parties have reached a tentative settlement valued at $12,457,350 CDN in a class action filed against Bristol-Myers Squibb Canada Company and Bristol-Myers Squibb Company on behalf of all Canadian residents who purchased Stadol NS nasal spray in Canada from July 1, 1994, to July 1, 2004. The action alleged that the nasal spray is addictive and that the defendants did not adequately warn patients of the possibility of addiction. The court has apparently not yet set a claims deadline-- persons eligible to take part in the settlement should contact attorneys for the class as soon as possible.
 
On May 5, 2005 the Court issued a permanent injunction against Creaghan A. Harry, who does business as Hitech Marketing, Scientific Life Nutrition, and Rejuvenation Health Corporation, by the Federal Trade Commission, on behalf of persons who have purchased bogus “human growth hormone” products over the Internet. The action alleged that Harry is responsible for millions of illegal spam email messages, all of which violate the FTC Act and the Controlling the Assault of Non-Solicited Pronography and Marketing Act of 2003 (CAN-SPAM Act).
 
Bausch & Lomb Inc. voluntarily suspended shipments of its ReNu brand contact lens solution after federal health officials linked it to a fungal eye infection that can cause temporary blindness. The eye-care company stopped shippingafter a number of people using the product reported getting a serious eye infection, claimed the Food and Drug Administration.
