A class action has been filed against debt collection agency Enhanced Recovery Corporation on behalf of all persons with Illinois addresses, to whom a collection letter was sent between July 16, 2003, and July 16, 2004. The action alleges that the defendants violated the federal Fair Debt Collection Practices Act by using deceptive trade practices in its attempts to collect a debt.

Two New Jersey law firms filed a complaint against Bank of America on June 1, 2005 in New Jersey Superior Court, Mercer County on behalf of Trenton resident Cindy Jones. The attorneys announced their intention to seek class action status to represent other identity theft victims as well against financial services giant Bank of America for damages resulting from the theft of tens of thousands of customer information files.

A class action lawsuit has been filed against AT&T Wireless Services, Inc. on behalf of wireless phone subscribers who requested termination of their wireless accounts and were then improperly charged an "adjustment" or other fees for services after the effective date of the termination. The suit seeks actual damages, as well as statutory and punitive damages, on behalf of the plaintiffs.

The parties have reached a proposed settlement of a class action against Community Bank of Northern Virginia, Guaranty National Bank of Tallahassee, and GMAC-Residential Funding Corporation on behalf of persons who took out a second mortgage from Community Bank of Northern Virginia or Guaranty National Bank of Tallahassee that was later purchased by GMAC-Residential Funding Corporation. Under the settlement, class members will receive payments of between $250 and $925. The settlement notice does not state the deadline for filing claims under the settlement.

The class has been certified in an action filed against debt collector Corporate Receivables, Inc. on behalf of all persons with Illinois addresses who, on or after September 17, 2001, were sent a letter seeking to collect an amount allegedly owed to Household. The action alleges that Corporate Receivables failed to state clearly the amount of the debt it was seeking to collect in violation of the federal Fair Debt Collection Practices Act.

Several class actions have been filed against specialty finance company NovaStar Financial, Inc. (NYSE:NFI) and certain of its officers and directors by stockholders who purchased the company's common stock between October 29, 2003, and April 8, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
