Airline Passengers Claim their Rights Were Violated by Unauthorized Disclosures of Confidential Information

A class action has been filed on behalf of passengers of American Airlines and its Subsidiaries against American Airlines, AMR Corp. and numerous other travel industry defendants. The case alleges that the defendants disclosed and shared confidential information about the passengers in violation of the Electronic Privacy Act. The case seeks to enjoin further information disclosures and seeks actual and punitive damages on behalf of the plaintiffs.

The complaint states that American gathered information about the passengers in the course of issuing tickets to them and providing travel services and later disclosed this information to and through AMR Corp. to a number of other agencies including Fair Isaac Corporation, a major consumer research bureau. The plaintiffs claim these disclosures were unauthorized and illegal.

The class is alleged to include at least 1.2 million passengers who traveled on American Airlines, American Eagle, and other affiliate airlines between September 2001 and July 2002.

A collective/class action spanning New York, New Jersey and Connecticut has been filed in New York against cable TV giant, Cablevision Systems Corporation. The action is brought on behalf of all current and former Cablevision customer services representatives who, since June 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week and who, since June 1998, were not paid full wages for all hours worked. The action is brought under the federal Fair Labor Standards Act and New York state labor laws and seeks back pay, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action under federal law, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. Those who join the case under the state law claims are not required to "opt-in"
 
A racial discrimination lawsuit filed against Woodward Governor Co. has now been as a class-action lawsuit. The ruling, issued by Judge Philip Reinhard, opens the case to at least 117 current and former minority workers at the Loves Park-based fuel control manufacturer. "This is a very significant junction," said Jennifer Soule, lead attorney for the 16 plaintiffs who originally brought the suit. "Because it's been certified as a class action, the plaintiffs can potentially obtain relief on behalf of all African Americans, Hispanics and Asians who have worked for the company for a number of years." The lawsuit, which was filed in May 2003 in U.S. District Court in Rockford, alleges that 14 blacks, one Hispanic and one Asian were intentionally discriminated against by Woodward because of their race. The suit also claims that Woodward has a racially hostile work environment and a racial composition less than the overall work force of Winnebago County.
 
A multi-state class action has been brought in Pennsylvania against Accredited Collection Agency, Inc. and attorney Norman G. Kalina. The action is brought on behalf of all Pennsylvania and New Jersey consumers who, since March 16, 2003, have been contacted by Accredited or Kalina in an effort to collect an alleged outstanding debt. The action is brought under the Federal Fair Debt Collection Practices Act and seeks actual and statutory damages as well as injunctive and declaratory relief.
 
African American employees who work as managers for the Sodexho Marriott corporation have brought a class action against the food service industry giant, alleging racial discrimination in the company's promotion process.
 
A national collective/class action has been filed in New York against The Eastman Kodak Company. The action is brought on behalf of all current and former technical support specialists or engineers, customer or technical support staff or repair and/or service staff from all Kodak operations, who since May 1998, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act as well as New York and other state labor laws and seeks back pay, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action under federal law, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. The state law claims are brought as standard class action claims with no requirement to "opt-in".
 
U.S. District Judge Dickran M. Tevrizian approved the final settlement of a class action, requiring Los Angeles County and the Los Angeles Superior Court to take specific steps to make local courthouse facilities more accessible to the disabled. The settlement represents a final resolution of claims brought four years ago by four disabled individuals, including Santa Monica attorney David G. Geffen, who is paralyzed as a result of a spinal cord injury and litigates disability, employment, and personal injury cases.
