Administrative Assistants Say Cosmetics Company Told them To Conceal Extra Hours Worked-- Workers Demand Fair Payment

A class action lawsuit has been filed on behalf of administrative assistants employed by cosmetics manufacturer Estee Lauder Companies, Inc. and certain of its affiliate companies. The suit alleges that Estee Lauder failed to pay its administrative assistants actual and overtime pay for all hours worked, as required by the Fair Labor Standards Act. The suit seeks actual and overtime pay, interest, and liquidated damages on behalf of the class.

The complaint alleges that Estee Lauder used a payroll system that required administrative assistants to call in and report their total hours worked each week. The complaint further alleges that Estee Lauder supervisors routinely directed the administrative assistants under their supervision to report no more than 35 hours per week, regardless of the actual number of hours worked. The administrative assistants who brought the action contend that administrative assistants at Estee Lauder routinely work more than 35 hours per week and sometimes work more than 40 hours per week.

The Federal Fair Labor Standards Act requires employers to keep accurate records of hours worked, to pay employees for all hours worked, and to pay overtime pay for hours worked in excess of 40 per week. Plaintiffs allege that Estee Lauder violated the FSA by requiring them to falsify their hours worked reports and depriving them of pay for any hours in excess of 35 per week.
