San Diego Association of Realtors Charged Smaller Firms More to Uses MLS System

On November 17, 2004, the Court approved the proposed settlement in a class action that had been filed against the San Diego Association of Realtors, the North San Diego Association of Realtors, the Pacific Southwest Association of Realtors, Incorporated, the East San Diego County Association of Realtors, Incorporated, the Coronado Association of Realtors and Sandicor, Incorporated for charging smaller realtors higher fees to a multiple listing service (MLS) than larger firms from 1990 to the present.

Specifically, the complaint alleged that although the defendants purportedly stopped fixing prices on July 1, 2003, the damages from the conspiracy have continued and that by the time the action reaches trial, there will be approximately five years of price fixing violations, for total damages of $1,200 per class member, for a total of $18 million. The complaint alleged that the number of plaintiff class members now exceeds 15,000.

A class action lawsuit has been filed in the Middle District Court of Florida against Lowe's Companies, Inc., a North Carolina based home improvement store with 1,000 stores in 45 states, for violations of the Fair Labor Standards Act (FLSA). Lawyers filed a a class action lawsuit against the operators of an alleged pyramid scheme in Louisville, Kentucky. The Phoenix Group and Eli Ohayon are named as defendants.
 
The parties have reached a tentative $2.3 million settlement of a class action filed against dietary supplements maker PharmaPrint, Inc. (Pink Sheets: PPRT, formerly OTCBB: PPRT) and certain of its officers and directors by stockholders who purchased the company's common stock between July 1 and November 15, 1999.
 
Attorneys recently filed a lawsuit seeking class-action status against E.I. du Pont de Nemours and Co. and one of the company's Canadian subsidiaries in response to a plan to provide prorated refunds to customers who purchased potentially hazardous fire safety devices that were recently recalled.
 
A class action has been filed against Wal-Mart for alleged abuses including abuses for off-the-clock work for which employees were never paid, missed meal and rest breaks, and altered time records. The class has a potential for 40,000 members and consists of all current and former hourly employees of Wal-Mart's 35 stores in Washington State from 1995 to present. The class seeks damages, restitution, and injunctive relief.
 
A $5 billion class-action lawsuit has been filed in federal courts by multiple attorneys in several states against DuPont Co. saying the company failed to warn consumers of the dangers of a Teflon chemical.
