Staten Island Cooks Seek Compensation from Elli's Associates

Report Fraud
Case ID: 3739 | Employment | 10/05/2004

A class action has been filed against Elli's Associates for violations of the Fair Labor Standards Act (FLSA) and the New York Minimum Wage Act, specifically for the failure to pay overtime to its employees. The class seeks their unpaid regular wages, unpaid overtime compensation, an additional 25 percent as liquidated damages, reasonable attorneys' fees and costs of the action.

Specifically, the complaint alleges that the plaintiffs were employed by the defendants from November 2003 to April 16, 2004 as restaurant workers to cook in two restaurants owned and operated in Staten Island, New York. The defendants allegedly underpaid the workers by refusing pay for overtime and for several weeks of work performed prior to their termination of employment.
