A class action lawsuit has been filed on behalf of uninsured patients who received and were billed for medical care by any hospital within the Oregon based Legacy Health Systems network of hospitals. The suit contents that Legacy billed its uninsured patients at rates far in excess of the rates employed for insured patients and that this practice was and is both discriminatory and illegal.
The complaint further states that Legacy enjoys non profit status and the associated tax benefits but in fact is highly profitable and paid its CEO over 1.4 million dollars in 2003. Plaintiffs seek financial damages and injunctive relief from Legacy, including the placement of all assets accrued by Legacy using unfair and deceptive practices into a constructive trust for the benefit of the plaintiff. These assets are alleged to be in the hundreds of millions of dollars. Hospitals within the Legacy network and covered by the complaint include Legacy Good Samaritan Hospital and Medical Center and Legacy Mt. Hood Medical Center. Other Drugs / Medical Cases of Interest Kahn Gauthier Swick is investigating possible legal actions against Biogen Idec and Elan because of two adverse events reported with the use of Tysabri (Natalizumab). Tysabri is used to treat MS (multiple sclerosis). The FDA received reports of one confirmed death and one possible case of progressive multifocal leukoencephalopathy (PML) in patients taking Tysabri. Several class actions have been filed against biopharmaceutical research company Allos Therapeutics, Inc., (Nasdaq:ALTH) and certain of its officers and directors by stockholders who purchased the company's common stock between April 23, 2003, and April 29, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. Kahn Gauthier Swick is investigating claims against pharmaceutical company Pharmacia on behalf of patients who have been prescribed the painkiller Bextra (valdecoxib) and later suffered side effects such as heart attack, stroke, severe skin reaction, or other adverse effects. Bextra, a COX-2 inhibitor, was approved by the federal Food and Drug Administration (FDA) on November 16, 2001, and was marketed in March, 2002. It can be prescribed for osteoarthritis, adult rheumatoid arthritis, and primary dysmennorhea. A settlement valued at 65 Million dollars has been reached in the consolidated action concerning alleged efforts by drug manufacturer Smith Kline Beecham to delay or impede the release of generic versions of the antidepressant drug Paxil, in order to continue selling the name brand drug at higher cost. On November 18, 2004 court ordered notification of potential claimainst began. Notices will be mailed, and are scheduled to appear in newspapers and magazines all over the United States, leading up to a hearing on March 9, 2005, when the Court will consider whether to approve the settlement. Kahn Gauthier Swick is seeking to file a lawsuit on behalf of persons that have certain Medtronic implantable heart devices. These products were surgically implanted in persons that are either prone to life-threatening heart rhythms, congestive heart failure or a combination of both. A class action has been filed against New York City Health and Hospital Corporation for retaliation and violations of overtime laws. The complaint alleges that Marjorie Barnwell worked for Kings County Hospital, but was not paid for overtime and that the Hospital retaliated against her when she confronted them. Barnwell is suing for unpaid overtime compensation and retaliation. |
