Cosmetic Teeth Whitening Employee Not All Smiles after Denied Overtime Pay

A class action has been filed against MSC Development, Inc., (MSC), a cosmetic teeth whitening company in Fort Worth, Texas (the Company does business as ‘Brighter Image Professional Teeth Whitening') and its President and Director, by a former employee who alleges that she was not paid overtime hours according to the Fair Labor Standards Act (FLSA).

Specifically, the complaint alleges that Rocksana R. Hernandez worked for MSC making custom fit teeth trays for use in MSC's cosmetic whitening process. Hernandez alleges that MSC regularly required her to work over forth (40) hours per week. However, rather than paying her one and one half times the regular rate of pay (as required by the Fair Labor Standards Act), MSC simply paid her at her regular rate of pay. She seeks damages for unpaid overtime compensation, liquidated damages, and attorneys' fees.
