Specifically, the complaint alleges that Rocksana R. Hernandez worked for MSC making custom fit teeth trays for use in MSC's cosmetic whitening process. Hernandez alleges that MSC regularly required her to work over forth (40) hours per week. However, rather than paying her one and one half times the regular rate of pay (as required by the Fair Labor Standards Act), MSC simply paid her at her regular rate of pay.
