Morgan Buildings & Spas Accused of Not Paying Overtime

A class action has been filed against Morgan Buildings & Spas, Inc., a manufacturer of buildings, spas and pools located in Texas, for violation of the Fair Labor Standards Act (FLSA). The complaint alleges that the Company did not pay employees for overtime hours worked over 40 according to FLSA regulations. The action seeks compensation for unpaid back wages, liquidated damages, costs of the suit, interest and attorneys fees.

Specifically, the complaint alleges that Harold Daniel worked for Morgan and was required to work 50 to 52 hours per week, but was not paid according to the time he actually performed work, but rather was paid for 40 hours regardless of the amount of time he actually worked.

A collective action with apparent national reach has been filed in Alabama against Sanders Oil Company. The action is brought on behalf of all persons employed by Sanders since February 1994, as assistant managers. The action is brought under the federal Fair Labor Standards Act and seeks back pay, statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered a member of the class. The managers have requested that the court issue notice to all potential claimants.
 
Norma Jean Williams, a former employee of a Salt Lake City Wal-Mart, filed a class-action lawsuit against the world's largest retailer, claiming that the employer altered records to cheat its employees. Williams is the only named plaintiff in the lawsuit filed in U.S. District Court for Utah. The lawsuit is one of many cases that allege evidence about Wal-Mart's non-payment of wages and forcing workers to work off the clock.
 
The University of Washington has agreed to settle a class-action lawsuit over faculty salaries. The case claimed that the UW's decision not to grant a general salary increase to its faculty in May 2002 had violated a salary policy adopted two years earlier. If the tentative settlement is approved by the King County Superior Court, eligible faculty members will receive a two percent salary increase and a share of a negotiated one-time payment of $17.45 million for back pay and interest. The cash payment will also be used to pay the plaintiffs' attorneys' fees and other expenses. The amount individual eligible faculty members receive will be based on their total earnings since 2002.
 
The parties have reached a tentative settlement in a class action filed against Shaw Industries, Inc., on behalf of California businesses and residents who performed work in connection with floor covering products under warranty by Shaw in California between September 19, 1998, and June 4, 2004. The action alleges that Shaw did not properly compensate its dealers for activities undertaken in connection with the service, repair, and replacement of floor covering products covered by warranty. Persons eligible to take part in the settlement should contact the attorneys for the class for more information.
 
When a corporate worker loses his or her savings because of executive decisions, the executives sometimes have to pay. A legal action has been filed against the John Endres, former owner of defense contractor Electro-Jet Tool & Manufacturing Company, and its executive officers on behalf of former Electro-Jet employees, who allege that the company's conversion from a profit-sharing plan to an employee stock ownership plan (ESOP) was carried out in a way that involved violations of federal pension law, breach of fiduciary duty, malpractice and fraud, destroying their built-up profit shares in the process.
 
A class action lawsuit has been filed in the Northern District Court of Illinois against Chilpancingo, Inc. The case involves violations of employment law. No additional information about the substance of the allegations is available at this time.
