Printing Company Accuses Global Paper Providers of Price Fixing

A class action has been filed against International Paper Company (Int'l) by Presswire Printing Company alleging that Int'l and others conspired in restraint of trade to artificially raise, fix, maintain or stabilize the price of publication paper in the United States from 1990 to the present.

Specifically, the complaint alleges that:

• Defendants exchanged information on prices being charged for publication paper sold to consumers
• Defendants agreed to charge prices at specified levels and otherwise to increase and/or maintain the price of publication paper in the US and elsewhere
• Defendants issued price announcements and price quotations in accordance with agreements reached
• Defendants sold publication paper in the US at non-competitive prices

The class members seek compensatory, punitive and attorneys' fees.

An FTC administrative proceeding has been filed against the Internet Marketing Group, Inc., and affiliated businesses OneSetPrice, Inc., RPM Marketing Group, Inc., National Events Coordinators, Inc.; First Choice Terminal, Inc.; First Choice Terminal, Inc.; and B & C Ventures, Inc., on behalf of consumers who bought into multipurpose public access Internet terminal and telephone calling card business ventures since August 2001. The action accuses the defendants of making false and unsubstantiated earnings claims, and misrepresenting their cancellation and refund policies, in violation of the FTC's Franchise Rule and Telemarketing Sales Rule.
 
The parties have reached a tentative multimillion dollar settlement in an action filed against United Parcel Service, Inc. on behalf persons who bought "excess value" package insurance from UPS going as far back as 1984. The action alleges that UPS overcharged for the insurance in violation of state and federal laws. Customers will be able to apply for UPS vouchers once the settlement is finalized.
 
On April 16, 2002, Ames True Temper, Inc. recalled about 650,000 wheelbarrows as a result of possible issues with plastic assemblies and rims. When filled with compressed air, the plastic wheelbarrow rims may break or even explode. This can cause plastic shards from the explosion to fly out possibly injuring consumers.
 
A statewide class action has been filed in Florida against Sears Home Improvement Services, Inc. The action is brought on behalf of all Florida residents who, since April 1999, have had vinyl siding installed by Sears on their home. The action alleges that Sears has violated Florida's Deceptive and Unfair Trade Practices Act by overestimating the amount of materials required for the installation job and then not crediting the purchasers for any unused material that was not in the estimate. The purchasers are seeking unspecified compensatory damages a well as injunctive and declaratory relief.

A class action has been filed against Internet site EZ Expo.com, Inc. on behalf of California consumers who allege that the site makes a $150 offer for a 42-inch plasma television that is nothing more than bait in a lottery that is illegal under California law.
