Plaintiffs Allege Caldeway Properties Violated Fair Debt Collection Practices Act

A class action has been filed against debt collector Caldeway Properties, Inc. on behalf of individuals who received collection letters from Caldeway containing language alleged to violate the fair debt collection practices act. The case seeks actual and punitive damages, attorney’s fees and costs.

The case alleges that Caldeway purchased credit card debts from another creditor who had terminated the credit program and then accelerated the debts. The original creditor ceased charging interest on the debts, but Caldeway continued the interest, at a daily rate, without disclosing that it was Caldeway, and not the original creditor, charging the interest. Caldeway is alleged to have used a standard form collection letter which violated the Fair Debt Collection Practices Act, entitling the plaintiffs to statutory damages and costs.

A class action lawsuit has been filed in the Southern District Court of Indiana against Commonwealth Financial Systems, Inc. for violations of the Fair Debt Collection Practices Act (FDCPA) which prohibits debt collectors from engaging in abusive, deceptive and unfair collection practices. Class members seek statutory damages, reasonable attorney's fees and costs of the litigation.
 
State and federal laws require that lenders deal with consumers in a straightforward and honest manner. The parties have reached a tentative partial settlement in a national class action against lenders First Union National Bank of Delaware, First Union Home Equity Bank, and First Union Home Equity Corporation on behalf of all persons who obtained a home equity or other loan that resulted in a mortgage from the lenders that was brokered or referred to First Union by either Pennsylvania Resource Corporation or First Liberty Financial Services at any time between May 10, 1995, and the eventual date of any judgment in the action.
