A federal judge ordered AK Steel Corporation to pay at least $46.2 million to 1,250 former employees in a class action lawsuit over pension benefits. A statewide collective action has been filed in Florida against Cingular Wireless, LLC. The action is brought on behalf of all current and former inside sales associates, who since February 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.

In the wake of such an action, a class action has been filed by employees of Emery Worldwide Airlines, Inc. against the shipping company, its parent company, CNF, Inc., and T. Rowe Price, who managed Emery's retirement accounts.
 
A class action has been filed against Connecticut Light & Power, a CT bases utilities company, (CL&P) by two former workers who were hired as independent contractors, but allegedly treated as employees. As independent contractors, the workers did not receive benefits according to CL&P’s ERISA and non-ERISA employee benefit plans. The workers claim that their job duties were identical to actual employees of CL&P and are suing for compensatory damages and lost benefits.
 
A class action lawsuit has been filed in the Southern District Court of Florida against Ross Stores, Inc. The case involves violations of the Fair Labor Standards Act which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. The action is brought on behalf of all current and former technical support specialists or engineers, customer or technical support staff or repair and/or service staff from all Kodak operations, who since May 1998, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act as well as New York and other state labor laws and seeks back pay, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action under federal law, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members. The state law claims are brought as standard class action claims with no requirement to "opt-in".
