Citizens Fight Back Against Ocean Township’s Unconstitutional Effort to Limit Rentals

A class action has been filed on behalf of renters and rental property owners in Ocean Township, New Jersey. The case alleges that the Township has enacted unreasonable and unconstitutional ordinances to reduce the number of rental property units within city limits. The plaintiffs seek to enjoin the city from enforcing these ordinances.

The complaint was filed by Ocean Citizens Against Housing Discrimination, an association of tenants and rental property owners. They allege that the Township, in an effort to discourage property rentals and increase the number of owner-occupied units within city limits, enacted an ordinance prohibiting the rental of a single residential unit to multiple individuals not related by blood or marriage. Plaintiffs allege this ordinance violates numerous federal and state fair housing laws and unfairly discriminates against certain groups, particularly the large number of college students who rent within the Township.

The complaint further alleges that another ordinance which limits the issuance of rental property certificates of occupancy in certain zones of the city to one per year, discriminates against both tenants and prospective rental property owners. Plaintiffs seek to have the ordinances declared unconstitutional and invalid. In addition, they seek compensatory and punitive damages.

This is the second class action lawsuit to be filed in recent days regarding efforts to limit rental housing in the vicinity of Monmouth College. A similar action was filed September 10, 2004 against the City of Long Branch, which also has high numbers of student tenants and enacted ordinances similar to those at issue in this case.

On 5/18/2004, the Magistrate Judge recommended conditionally certifying a class of all loan officers employed by Oak Street at one of its branch offices located in Greenville, South Carolina, Atlanta, Georgia, St. Petersburg, Florida or Ocala, Florida.

A statewide collective action has been filed in Massachusetts against the Town of Agawam and the Agawam Police Department. The action is brought on behalf of all Agawam police officers who have not been paid proper overtime compensation for all hours worked in excess of 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory damages, liquidated damages and injunctive and declaratory relief. As a collective action, all potential claimants are required to "opt-in" to the case in order to be considered a part of the class. The officers have requested that the court issue notice to all potential claimants.
 
A nationwide class action has been filed against the US Department of Agriculture on behalf of black farmers who farmed or attempted to farm between January 1, 1997, and August 30, 2004, and who allege that the agency has conspired to take their land through tacit racial discrimination expressed through government farm loan and program policies. The lawsuit alleges that the USDA has violated the 14th amendment of the American Constitution, the federal Civil Rights Act of 1964, and the Equal Credit Opportunity Act, and seeks at least $20.5 billion in damages.

As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
