Citizens Fight Back Against City’s Unconstitutional Effort to Limit Rentals in Long Branch

A class action has been filed on behalf of renters and rental property owners in the City of Long Branch, New Jersey. The case alleges that the City has enacted unreasonable and unconstitutional ordinances to reduce the number of rental property units within city limits. The plaintiffs seek to enjoin the city from enforcing these ordinances.

The complaint was filed by Long Branch Citizens Against Housing Discrimination, an association of tenants and rental property owners. They allege that the City, in an effort to discourage property rentals and increase the number of owner-occupied units within city limits, enacted an ordinance prohibiting the rental of a single residential unit to multiple individuals not related by blood or marriage. Plaintiffs allege this ordinance violates numerous federal and state fair housing laws and unfairly discriminates against certain groups, particularly the large number of college students who rent within the city.

The complaint further alleges that another city ordinance which limits the issuance of rental property certificates of occupancy in certain zones of the city to one per year, discriminates against both tenants and prospective rental property owners. Plaintiffs seek to have the ordinances declared unconstitutional and invalid. In addition, they seek compensatory and punitive damages.

A statewide collective action has been filed in Florida against Custom Pak, Inc. The action is brought on behalf of all current and former employees, who since March 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
The parties have reached a tentative $2.7 million settlement in two actions filed against Rensselaer County, New York, on behalf of persons who were admitted to the county jail from June 26, 1999, through July 1, 2002, and strip-searched after being charged with only a misdemeanor, traffic infraction, parole or probation violation, or civil commitment. Persons eligible to take part in the settlement must submit a claim form that is postmarked by July 29, 2004, to be included in the class.
 
A statewide class action has been filed in Oklahoma Against Viking Collection Service, Inc. The action is brought on behalf of all Oklahoma consumers who were contacted by Viking regarding an alleged debt and who were subject to allegedly abusive and unfair collection attempts. The action is brought under the federal Fair Debt Collection Practices Act and seeks compensatory, statutory and punitive damages as well as injunctive and declaratory relief.
 
A statewide class action has been filed in Pennsylvania against collection specialists Debt Enforcement Bureau, Inc. The action is brought on behalf of all Pennsylvania consumers who, since May 12, 2003, received form type collection letters from Debt Enforcement that contained language regarding potential lawsuits as well as mentioning the Sheriff's Department. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
A national collective action has been filed in Florida against retail video and computer game giant, Electronics Boutique of America, Inc. The action is brought on behalf of all current and former employees, who since March 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. A statewide class action has been filed against the Illinois Department of Corrections and its employee, Michael McManus, on behalf of all past and present female employees of the department who allege they have been discriminated against on the basis of their sex. The employees are seeking compensatory, statutory and punitive damages.
