Mack Construction Services Accused of Not Paying Overtime

A class action has been filed against Mack Construction Services, Inc. (Mack) and its owners for allegedly violating the Fair Labor Standards Act (FLSA). The complaint alleges that the Company is subject to the provisions of the FLSA, knew that they must pay their employees overtime compensation, required employees to work overtime, but did not pay for overtime hours worked.

Specifically, the complaint alleges that Roy Lee was employed by Mack from March, 2002 through June, 2003 and Kenneth Nuttler was employed by Mack from October 2002 through April, 2004. During some of those times, each employee worked over forty (40) hours per week and was entitled to overtime pay of one and one half times their regular rate of pay pursuant to the FLSA.

The complaint alleges that Mack was aware of their obligation to pay overtime, but did not. The former employees, and anyone similarly situated, are suing Mack for unpaid overtime wages.

The managers have requested that the court issue notice to all potential claimants in an effort to inform them of the pending action.
 
A class action lawsuit has been filed in the District Court of Southern Florida against EPT Management Company. The case involves violations of the Fair Labor Standards Act which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. No additional information about the substance of the allegations is available at this time.
