Sears MasterCard Holders Reach $185,000 Settlement in Promotional Check Action

The parties have reached a tentative $185,000 settlement in a class action filed against Sears National Bank, doing business as Sears MasterCard, on behalf of all Sears national Bank MasterCard holders who participated in the March 2001 promotion offered by Sears MasterCard for 2.9% interest for four months on all promotional checks clearing Sears National Bank on or before May 1, 2001, and who did not receive the 2.9% interest rate. Claim forms must be postmarked on or before October 30, 2004, in order to be considered valid.

Class members who submit claim forms in a timely manner will receive the lesser of: (1) $53.85 per $1000 in total face value of that class member’s qualified check(s); or if the total payment to all eligible class members exceeds the total available settlement fund, each member will receive a pro rata share based upon the ratio of their total checks’ face value to the total face value of all checks written by all participating class members.

The settlement will not be effective until the court grants it final approval. The court has scheduled a hearing on the matter for December 14, 2004.

A class action lawsuit has been filed in the Eastern District Court of Pennsylvania against National Action Financial Services, Inc. for violations of the Fair Debt Collection Practices Act (FDCPA) which prohibits debt collectors from engaging in abusive, deceptive and unfair collection practices. Class members seek damages, attorney's fees and costs of the litigation.
 
A class action lawsuit has been filed on behalf of Kansas residents who were the subject of garnishment proceedings initiated by Midwest Checkrite, Inc. The suit alleges that Midwest Checkrite failed to adhere to the requirements of the federal fair debt collection practices act with respect to its garnishment efforts.
 
A class action has been filed in Kentucky against the Serban Law Offices and Attorney Daniel Serban. The action is brought on behalf of all Kentucky residents who since October 17, 2002, have received a collection "form" letter from the Serban Law Offices or Daniel Serban. The action alleges that these "form" collection letters do not meet the requirements of the federal Fair Debt Collection Practices Act.
 
State and federal laws limit the amount of interest that a business may charge on a loan. The parties have reached a tentative settlement in an Indiana class action against short-term loan provider E-Z Cash Systems, Inc. on behalf of all persons who took out a loan with the business and were forced to pay an interest rate that was allegedly too high in violation of state and federal lending laws.
 
A statewide class action has been filed in Indiana against collections specialist Account Receivable Collections, LLC. The action is brought on behalf of all Indiana consumers who received an initial collection letter from Account Receivable that demanded immediate payment of their debt. The action is brought under the Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
