More School Employees Claim The Broward County School Board Denied Them Overtime Compensation

As the result of an alleged continuous pattern of labor violations, another collective action has been filed in Florida against the School Board of Broward County, Florida. The action is brought on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the board. The action is brought under the federal Fair Labor Standards Act and is seeking back pay as well as statutory damages, liquidated damages and declaratory relief.

According to employees, the School Board of Broward County, Florida has engaged in a systematic and intentional pattern of disregarding federal law in the manner in which it compensates school workers. The workers who bring this action are paid hourly wages and allege that they are not exempt from overtime compensation under the federal Fair Labor Standards Act. The employees allege that in the normal course of their employment, they commonly work well in excess of 40 hours a week. However, they claim that the Broward County School Board does not compensate them for hours worked in excess of 40 weekly. Under the federal Fair Labor Standards Act, they are entitled to compensation at a rate of time and a half for all hours beyond 40 they work in a week.

The workers assert that the board has failed to keep accurate records of hours worked, has failed to apprise employees of their rights under the Fair Labor Standards Act and that the School Board has no provisions in effect to properly compensate employees for overtime hours. The workers claim that these violations of the Fair Labor Standards Act are the means in which the School Board has been able to defraud the workers of overtime pay. This action is a collective action, and therefore potential plaintiffs must opt-in to the case. The employees have requested that the court issue notice to all potential claimants.

Several current and former African American workers at Super Steel claim the company conducts a hate filled work environment. The lawsuit was filed in federal court on behalf of nine workers. The workers claim over the past several years they experienced racist remarks, vandalism to their lockers, and a segregated environment in the break room. Workers state the company has not done enough to stop the problem despite repeated complaints to superiors.
 
A class action lawsuit has been filed in the United States Disctict Court for the Middle District of Alabama against Green Tree Servicing, LLC. The case involves violations of employment law and focuses on the Fair Labor Standards Act (FLSA). No additional information about the substance of the allegations is available at this time. A statewide collective action has been filed in Florida against Outreach Senior Healthcare, Inc. and Outreach Programs, LLC. The action is brought on behalf of all Florida residents who are either currently, or have been since January 2, 2001, employed by Outreach Senior or Outreach Programs and were not paid overtime compensation. The action is brought under the federal Fair Labor Standards Act and seeks statutory, compensatory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants must voluntarily "opt-in" to the case in order to be considered part of the class. The employees have requested that the court issue notice to all potential claimants in this case.
