Canadians with Dow Corning Silicone Implants Settle with Company for $35+ Million

The parties have reached a $35+ million USD settlement in three class actions filed against Dow Corning on behalf of Canadians who claim that silicone surgical implants have caused them health problems, in violation of Canadian consumer protection statutes. There are numerous claims deadlines that range from August 30, 2004, to June 3, 2019, depending on the type of claim that is being filed. Persons eligible to take part in the settlements should visit the settlement websites for more information.

There are three separate settlements: one for residents of Ontario, one for residents of Québec, and one for persons who reside in British Columbia or any other Canadian province. Persons eligible to participate may only take part in one settlement. The province in which you reside, or resided in at the time you had implant surgery, determines which settlement you should take part in. More information is available at the Claimants’ Advisory Committee website, and the settlement websites for each individual proceeding.

Specific medical claims covered in the settlement consist of:

Atypical Connective Tissue Disease (ACTD);
Atypical Neurological Disease Syndrome (ANDS);
Primary Sjogren's Syndrome (PSS);
Mixed Connective Tissue Disease (MCTD)/ Overlap Syndrome;
Systemic Sclerosis / Scleroderma (SS);
Systemic Lupus Erythematosus (SLE);
Polymyositis (PM);
Dermatomyositis (DM); and
General Connective Tissue Symptoms (GCTS)

Those persons who do not currently have health problems related to their implants, but are unsure and feel that they may develop health problems in the future, should submit a claim to remain eligible to make a claim in the future.

To ensure that claimants meet the claim deadlines, it is recommended that: (1) they immediately contact the doctor, hospital or clinic that performed the implantation of their implant(s) to obtain product identification documentation establishing that Dow Corning implant(s) or implants containing Dow Corning implant raw materials were used; and (2) once the required documentation arrives, immediately forward it to the claims administrator with the completed and signed registration form.

Compensation will also be available for some family members, as well as for person who received implants containing raw materials made by the company. Ontario claimants can get instructions on filing a claim at www.ontdowcorning.ca. Quebec residents can call 514-393-5222, while persons residing in British Columbia and other provinces can find information at www.canadianbreastimplantsettlement.com.

About 170,000 women have filed claims over breast implants, with another 75,000 people filing claims over other kinds of silicone implants, including joint and facial implants.

Dow Corning was granted bankruptcy protection in 1995 after being faced with 19,000 lawsuits.

Other Drugs / Medical Cases of Interest

The parties have agreed on a settlement in several class actions that had been filed against Vaso Active Pharmaceuticals, Inc. (OTCBB:VAPH; formerly Nasdaq:VAPH) and certain of its officers and directors by stockholders who purchased the company's common stock between December 11, 2003, and March 31, 2004. The actions claimed that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
A class action has been filed against disease management program provider Matria Healthcare, Inc. (Nasdaq: MATR) and certain of its officers and directors by stockholders who purchased the company's common stock between October 24, 2001, and June 25, 2002.
 
Kahn Gauthier Swick is investigating possible legal actions against Cordis Corporation on behalf of persons who have been injured by the company's Cypher coronary stent. On October 29, 2003, the federal Food and Drug Administration issued a warning that a significant number of adverse effects had been reported since the Cypher stent was approved on April 24. Both blood clotting and hypersensitivity reactions have been reported.
 
What good is insurance if it doesn’t pay up when you need it? The parties have reached a $20 million settlement in an action filed against Midwestern insurance company Central States Health and Life Company of Omaha on behalf of cancer patients and their families who alleged that the company refused to pay for certain treatments allegedly covered under cancer insurance policies it sold, in violation of its contracts with the patients. Persons eligible to take part in the settlement should contact class counsel for more information.
 
The parties have reached a tentative settlement valued at $12,457,350 CDN in a class action filed against Bristol-Myers Squibb Canada Company and Bristol-Myers Squibb Company on behalf of all Canadian residents who purchased Stadol NS nasal spray in Canada from July 1, 1994, to July 1, 2004. The action alleged that the nasal spray is addictive and that the defendants did not adequately warn patients of the possibility of addiction. The court has apparently not yet set a claims deadline-- persons eligible to take part in the settlement should contact attorneys for the class as soon as possible.
 
Lipitor is the #1 prescribed cholesterol-lowering drug in the United States. A nationwide class action has been filed against pharmaceutical distributors Albers Medical, Inc., and Med-Pro, Inc. on behalf of consumers who allege that the companies repackaged and distributed counterfeit Lipitor and possibly other drugs as well. The action alleges that the companies violated the federal Racketeer Influenced Corrupt Organizations Act and the Missouri Merchandising Practices Act in distributing the counterfeit drugs.
