Florida Employees of J&B Today's, Inc. Seek Overtime

A statewide collective action has been filed in Florida against J&B Today's, Inc. The action is brought on behalf of all current and former hourly employees of all Florida J&B Today's stores, who since May 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.

According to employees, J&B Today's has engaged in a willful and intentional course of action to defraud them of proper overtime compensation. The employees claim that J&B Today's frequently requires them to work well in excess of 40 hours per week, sometimes as much as 80 or 90 hours. However, according to employees, the company has no provisions in place to properly compensate employees for overtime for hours worked in excess of 40 per week and only pays them "straight time" for overtime hours. Under the Fair Labor Standards Act, all hourly "non-exempt" employees are entitled to a minimum of time and a half for all hours worked in excess of 40 per week. "Non-exempt" employees are generally those that work on an hourly basis and do not have managerial or executive responsibility. The employees, who were all paid on an hourly basis, claim that they are "non-exempt" and therefore entitled to receive overtime compensation for all hours worked beyond 40 per week. The employees also claim that because J&B Today's refusal to pay overtime was willful and intentional, they are entitled to an equal amount of liquidated damages.

A class action has been filed on behalf of home health care workers employed by the Central State Community Services, Inc., a Tulsa based provider of home health services. The suit alleges that workers employed at Central State between 2001 and 2004 routinely worked more than 40 hours a week but were not paid overtime as required by the Federal Fair Labor Standards Act. The plaintiffs seek an award of the unpaid overtime with interest, attorney’s fees and costs, as well as liquidated damages and equitable relief.

The class has been certified in a class action filed against Combined Insurance Company of America on behalf of current and former female sales agents and managers who, after March 8, 2002, were members of Combined's "Seventh Essential Enhanced Sales Force." The action alleges that Combined has engaged in a pattern or practice of sex discrimination toward and sexual harassment of women in violation of Title VII of the federal 1964 Civil Rights Act.
 
A class action has been filed against Kraft Foods North America, Inc. on behalf of African-American employees at a Nabisco bakery in Philadelphia who allege that they were more often passed up for promotions and disciplined more severely than their white co-workers, in violation of Title VII of the federal Civil Rights Act of 1964.

The action is brought on behalf of all hourly employees of JAL who were not paid proper overtime compensation. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action, all potential claimants are required to "opt-in" to the case in order to be considered a member of the class. The employees have requested that the court issue notice to all potential claimants.
