Florida Employees of World Gym Press for Overtime

A statewide collective action has been filed in Florida against Xtreme Sport of Palm Beach, Inc. who does business as World Gym. The action is brought on behalf of all current and former hourly employees, classified as “managers”, employed by any Florida based World Gym, who since April 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.

According to employees, World Gym has engaged in a willful and intentional course of action to defraud them of proper overtime compensation. The employees claim that World Gym frequently requires them to work well in excess of 40 hours per week. However, according to employees, the company has no provisions in place to properly compensate employees for overtime for hours worked in excess of 40 per week. Under the Fair Labor Standards Act, all hourly "non-exempt" employees are entitled to a minimum of time and a half for all hours worked in excess of 40 per week. "Non-exempt" employees are generally those that work on an hourly basis and do not have managerial or executive responsibility. The employees, who hold any "manager" position that pays on an hourly basis, claim that they are "non-exempt" and therefore entitled to receive overtime compensation for all hours worked beyond 40 per week. The employees also claim that because World Gym's refusal to pay overtime was willful and intentional, they are entitled to an equal amount of liquidated damages.

The employees have requested that the court issue notice to all potential class members. Those who join the case under the state law claims are not required to "opt-in"
 
A collective action has been filed in Florida against data processing giant, NCCI Holdings, Inc. The action is brought on behalf of all hourly employees who were not paid overtime compensation by NCCI for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks back pay, statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants must "opt-in" in order to be considered a member of the class. The employees have requested that the court issue notice to all potential claimants.
 
A class action lawsuit has been filed in the Northern District Court of Texas against Eyelane, Inc., a Texas optometrist for violations of the Fair Labor Standards Act (FLSA). Class members seek unpaid compensation, attorney's fees, costs and interest.
 
California's labor laws grant its workers protections not found in many other states. The class has been certified in an action filed against Labor Ready, Inc. on behalf of California employees who allege that the company failed to pay them correctly, wrongly withheld sums from their pay, and failed to rovide them with itemized wage statements in violation of California's Unfair Competition Law and Labor Code between February 14, 1997, and the present. Eligible participants do not need to take any action at this time to remain a member of the class.

A class action lawsuit has been filed in the United States District Court, Southern District of Florida against Lonocchio’s, Inc. The case involves violations of employment law pertaining to the Fair Labor Standards Act (FLSA). No additional information about the substance of the allegations is available at this time.
