Bristol-Myers Squibb Settles Canadian Claims that Stadol Nasal Spray Caused Addiction

The parties have reached a tentative settlement valued at $12,457,350 CDN in a class action filed against Bristol-Myers Squibb Canada Company and Bristol-Myers Squibb Company on behalf of all Canadian residents who purchased Stadol NS nasal spray in Canada from July 1, 1994, to July 1, 2004. The action alleged that the nasal spray is addictive and that the defendants did not adequately warn patients of the possibility of addiction. The court has apparently not yet set a claims deadline-- persons eligible to take part in the settlement should contact attorneys for the class as soon as possible.

Stadol is no longer being distributed into the Canadian market. Persons who used Stadol NS may obtain compensation based on how many bottles of the drug they purchased and what types of difficulty they experienced as a result of any dependence. The details of how payments will be calculated are laid out in the settlement notice that has been approved by the court. A preliminary copy of the notice may be viewed at the settlement web site.

The Ontario Superior Court of Justice will determine if the settlement is in the best interests of class members in a proceeding scheduled for June 28, 2004. If the settlement is approved, further notice will be published giving Class members the option of filing a claim or opting-out of the settlement.

Uninsured hospital patient Robert Honke filed a lawsuit against Alton Memorial Hospital in Madison County Circuit Court, Illinois. Honke claims AMH charged him more for services than for patients with health insurance. According to the complaint, AMH was to only charge Honke reasonable and customary rates for healthcare services and he would only be obligated to pay reasonable charges for the services he received.
 
Kahn Gauthier Swick is investigating possible legal actions against EndoVascular Technologies, Inc., a wholly-owned subsidiary of medical device manufacturer Guidant Corporation, on behalf of persons who were implanted with EndoVascular's Ancure Endograft System, which is used to repair abdominal aorta aneurysms.

The parties have reached a tentative $3.5 million settlement in an action filed against David E. Tremoglie, the HMO that employed him, its malpractice insurer, and related companies. The action alleged that Mr. Tremoglie masqueraded as a psychiatrist in violation of state and federal medical licensing regulations. Persons who were treated by Mr. Tremoglie should contact the attorneys for the class as soon as possible, to be able to participate in the settlement.
