The parties have reached a tentative settlement apparently valued at $681,000 and an action filed against maker of McAfee software products, Network Associates, Inc., on behalf of all U.S. residents who purchased McAfee VirusScan version 3 or 4. The action alleged that Network Associates promised to provide perpetual updates to its software, and failed to do so. On April 7, 2004, the court certified a class that includes all U.S. residents who licensed versions 3 or 4 of McAfee VirusScan software. The class does not include non-U.S. residents. The plaintiffs allege that Network Associates has violated California state law and breached their license agreements by failing to provide free lifetime updates to purchasers of versions 3 and/or 4 of McAfee VirusScan software. The class action asserts claims under California consumer protection laws and the California Civil Code.
Class members are able to obtain a free download of the perpetual version of one of the following: (1) McAfee VirusScan version 8, (2) AntiSpyware version 1.0 or (3) QuickClean version 4.01 (or the most recent versions at the time of download) software from www.mcafee.com until July 16, 2004. Persons eligible to take part in the settlement should go to http://software.mcafee.com/lcas/ and complete an on-line form certifying that they are members of the class.
