UICI Reaches $25 Million Settlement with Persons Insured Through “Association Groups”

The parties have reached a tentative settlement apparently valued at $25 million in several actions filed against UICI, Inc., and its principal insurance subsidiaries MEGA Life and Health Insurance Company and Mid-West National Life Insurance Company of Tennessee on behalf of policyholders insured through groups associated with the companies. Persons eligible to take part in the action should contact the attorneys for the class for more information.

The proposed nationwide settlement class of current and former MEGA and Mid-West insureds and current and former members of the associations will be entitled to relief in the form of free insurance coverage for a period of months under a personal accident policy to be issued by a UICI subsidiary (covering, among other things, accidental death and out-patient and hospital costs incurred as a result of specified accidents) and discounts on association membership fees. This coverage will not amount to a full health benefit plan.

Since late 2002, UICI has been beset by lawsuits alleging the company sold insurance policies through business associations without properly revealing close links to those organizations. The associations, including the National Association for the Self-Employed and the Alliance for Affordable Services, were managed by executives with direct ties to UICI. The lawsuits allege that members of the associations were recruited by UICI's insurance subsidiaries with "teaser rates" that soon were hiked up.

In addition to free insurance, MEGA and Mid-West have agreed to include enhanced disclosures in their marketing and sales materials with respect to the contractual relationships between UICI and the insurance companies, on the one hand, and the associations, on the other. MEGA and Mid-West have also agreed to enter into an injunction with respect to certain business practices.

This settlement resolves claims made in suits filed in Texas, California, and Mississippi. The defendants continue to be parties to pending "association group" cases in at least three other states.

The settlement will not be effective until the court grants it final approval. The court has not yet scheduled a hearing on the matter.

A class action lawsuit has been filed in federal court against General Reinsurance Corporation. The case involves violations of federal racketeering and corruption laws. No additional information about the substance of the allegations is available at this time. WellPoint Inc., the nation's biggest publicly traded health insurer, said July 11, 2005 it will pay up to $198 million to settle two class-action lawsuits brought by representatives of more than 700,000 doctors over alleged unfair payment practices.
