National Class Action Targets Central Credit Services Inc.'s Collection Calls

A national class action has been filed in New York against Central Credit Services, Inc. The action is brought on behalf of all U.S. residents who have been contacted via telephone by Central Credit and who have been allegedly harassed by Central's collection associates. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.

According to consumers, Central Credit Services has engaged in conduct that grossly violates the federal Fair Debt Collection Practices Act. Under the act, any and all communications between a debt collector and consumers that are misleading, untrue, coercive or unfair are strictly forbidden. The consumers allege that Central Credit has a policy of using threatening telephone communications in an effort to collect debts for third parties. The consumers claim that Central Credit called them repeatedly, harassing and insulting them on the phone. The consumers further claim that Central Credit threatened them with litigation, when no litigation was proper or even filed, and refused to validate alleged debts when they were informed by consumers that the debts were under dispute. Additionally, the consumers allege that Central Credit informed them that hiring an attorney would be a waste of time, since the consumers would lose in court regardless and that is was "open season" on them according to Central Credit. These actions, according to consumers, were false, misleading, coercive and unfair, entitling them to damages under the Fair Debt Collection Practices Act.

A national class action has been filed in New York against debt collection specialists Valentine & Kerbatas, Inc. on behalf of all U.S. residents who have, since November 5, 2002, received a first collection letter from Valentine & Kerbatas in which the debtor is informed that the debt is immediately due as a result of the debtor's lack of response to Valentine & Kerbatas' previous collection efforts. The debtors, who seek declaratory relief and statutory damages, allege that Valentine & Kerbatas has violated the federal Fair Debt Collection Practices Act.
 
A nationwide class action has been filed against credit repair service QCS Online, Inc., which does business as Quality Credit Services, on behalf of persons who paid the company up front for credit repair services. The action alleges that the company violates the federal Credit Repair Organizations Act by accepting payment before any promised service has been fully performed, and seeks unspecified compensatory and punitive damages.
 
The parties have reached a proposed settlement of a class action against Community Bank of Northern Virginia, Guaranty National Bank of Tallahassee, and GMAC-Residential Funding Corporation on behalf of persons who took out a second mortgage from Community Bank of Northern Virginia or Guaranty National Bank of Tallahassee that was later purchased by GMAC-Residential Funding Corporation. Under the settlement, class members will receive payments of between $250 and $925. The settlement notice does not state the deadline for filing claims under the settlement.
 
A statewide class action has been filed in Indiana against collection specialists Weltman, Weinberg & Reis. The action is brought on behalf of all Indiana consumers who received standard form type collection letters from Weltman, Weinberg & Reis which failed to provide an accurate accounting of the consumer's outstanding debt. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
A national class action has been filed in New York against collection specialist, Maximus, Inc. The action is brought on behalf of all U.S. residents who received a collection letter from Maximus which demanded payment within 30 days. Consumers claim this demand has the effect of overshadowing the statutorily required statement entitling consumers to challenge the validity of the alleged debt. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
Baltimore lending company, Admiral Mortgage Inc., faces a class action lawsuit accusing it of charging excessive fees on its secondary mortgage loans and other predatory lending practices. Plaintiffs in the case are Rodney G. Coster and Teresa L. Coster of Essex, Md., and Amanda Connor and Kevin F. Ashe of Rosedale, Md. The Costers claim that Admiral charged them an origination fee of $5,936 on a $74,200 second mortgage -- 8 percent of the loan amount. They also allege they were charged more than $1,400 in credit report, processing, document preparation and underwriting fees.
