Two classes have been certified in several consolidated class actions filed against pharmaceutical company Glaxosmithkline, PLC, on behalf of persons who purchased the brand-name drug Relafen or its generic alternatives (known as Nabumetone) in Arizona, California, Massachusetts, or Vermont, or who purchased Relafen in Tennessee. The action alleged that GSK fraudulently obtained a patent to prevent a generic version of Relafen from coming to market, in violation of state and federal antitrust laws. Persons eligible to take part in the action should contact attorneys for the class.
Relafen is a non-steroidal anti-inflammatory manufactured and sold by GlaxoSmithKline (“GSK”). It is used in the treatment of arthritis, rheumatism, gout, bursitis, tendonitis, and menstrual cramps. You are a class member if you purchased the brand-name drug or its generic alternatives in Arizona, California, Massachusetts, or Vermont, or if you purchased Relafen (not a generic) in Tennessee during the period of September 1, 1998, through June 30, 2003, for your own consumption or for your family. In August 2001, the court ruled that GSK’s patent covering nabumetone was both invalid and unenforceable due to the company’s inequitable conduct. Following that decision, antitrust lawsuits were filed by individual generic manufacturers and individual direct purchasers alleging that GSK violated antitrust laws by prosecuting sham patent infringement litigation against generic manufacturers. In February 2004, GSK agreed to settle claims bad direct purchasers, such as distributors, for $175 million. That settlement does not affect the claims of end-payer purchasers, for whom a trial date is tentatively scheduled for June 2004. The action alleged that the marketers made deceptive advertising claims about Ultra Carb in violation of federal consumer protection laws.
