Major Cellular Phone Services Settle Wireless Equipment Insurance Action for $5 Million

The parties have reached a tentative nationwide $5 million settlement in an action filed against major cellular phone services and three insurance companies on behalf of all persons who purchased wireless equipment insurance between January 1, 1986, and February 20, 2004, through a wireless equipment insurance program administered by Asurion Insurance Services, Inc., Lockton Companies, Inc., or Lock\Line, LLC. The action alleged that the insurance programs failed to comply with applicable state insurance statutes and were marketed in a manner that failed to comply with Pennsylvania's consumer protection statutes. Proof of claim forms must be postmarked on or before August 9, 2004, to be considered valid.

The cellular defendants named in the action are: Verizon Wireless, Price, Alltel, Sprint PCS, Cingular Wireless, AT&T Wireless, Centennial Communications, Rural Cellular, Dobson Cellular, and Western Wireless.

As part of the settlement, the defendants will provide long distance phone cards with a $0.10 per minute retail value, for a maximum potential value of 50 million minutes, which will be divided on a pro-rata basis among all persons who submit a valid proof of claim. The actual value of each of the cards will be determined based on the number of settlement participants. Each participant will be entitled to receive a phone card with a face value of up to $5.00. The cards will expire 180 days after the date on which they are issued or at such other date as may be ordered by the court. They will be transferable, meaning that participants will be able to give them to other people.

The settlement will not be effective until the court grants it final approval. The court has scheduled a hearing on the matter for November 4, 2004.

A Florida appeals court has ruled that a massive rate hike for windstorm insurance on coastal homes was approved improperly four years ago. The underlying class action against the Florida Windstorm Underwriting Association has been remanded to the trial court for further proceedings. The decision opens the way for refunds or credits to the 400,000 homeowners covered by the state's windstorm insurance pool when the rate hike was imposed. Persons affected by the insurance hike should contact attorneys for the class for more information.
 
A class action has been filed against the Hartford Financial Services Group (NYSE: HIG) and certain of its officers and directors by stockholders who purchased the company’s common stock between November 5, 2003 and October 13, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company’s securities. The stockholders seek to recover compensatory damages for the loss of value of their stock.
 
On 12/13/04, CIGNA HealthCare announced that it has reached a settlement in lawsuits brought on behalf of a nationwide class of specialty health care providers and certain state and national associations. The agreement must be approved by the United States District Court in Miami.
 
Kahn Gauthier Swick is investigating possible legal actions on behalf of persons injured or killed in motor vehicle accidents. Over 41,000 people are killed in motor vehicle accidents in the United States every year.
 
The Ohio State Insurance Fund for injured workers said it will pay $52 million to workers hurt on the job who won a class-action lawsuit that accused the agency of wrongly taking back payments for their injuries. The settlement affects about 7,900 workers that will receive the reimbursement for money taken under 1993 and 1995 laws that were later declared unconstitutional by the state Supreme Court.
