California Longs Drug Stores Managers and Assistant Managers Demand Overtime Pay |

A class action has been filed against Longs Drug Stores Corporation on behalf of all current or former store managers or assistant store managers in a California Longs Drug Store since February 17, 2000. The action alleges that the company has failed to pay these employees overtime as required by state law, is refused to allow them rest and meal breaks, and has failed to provide them with accurate itemized wage statements as required by the state of California. The action seeks unspecified compensatory damages.
The action alleges that Longs operates approximately 380 drug stores in California. Since February 2000, the company has allegedly classified store managers and assistant store managers as exempt from overtime wages. Managers allegedly work in excess of eight hours per day and 40 hours per week on a regular basis, without any compensation for their overtime hours.
In addition, managers normally have no time to take rest breaks, and they allegedly do not receive a 30 minute meal break within the first five hours of their shift as required by state law. The action alleges that, despite their job titles, store managers and assistant managers are not engaged primarily in management duties. They spend the vast majority of their time performing the same work that is performed by nonexempt employees whom the managers supposedly supervise.
