A collective action has been filed in Florida against the School Board of Broward County, Florida. The action is brought on behalf of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the board. The action is brought under the federal Fair Labor Standards Act and is seeking back pay as, statutory damages, liquidated damages and declaratory relief.
According to employees, the School Board of Broward County, Florida has engaged in a systematic and intentional pattern of disregarding federal law in the manner in which it compensates school workers. The workers who bring this action are paid hourly wages and assert that they are not exempt from overtime compensation under the federal Fair Labor Standards Act. The employees allege that in the normal course of their employment, they commonly work well in excess of 40 hours a week. However, they allege that the Broward County School Board did not compensate them for hours worked in excess of 40 weekly. Under the federal Fair Labor Standards Act, they are entitled to compensation at a rate of time and a half for all hours beyond 40 they work in a week. The workers assert that the board has failed to keep accurate records of hours worked, has failed to apprise employees of their rights under the Fair Labor Standards Act and that the School Board has no provisions in effect to properly compensate employees for overtime hours. The worker claim that these violations of the Fair Labor Standards Act are the means in which the School Board has been able to defraud the workers of overtime pay. This action is a collective action, and therefore potential plaintiffs must opt-in to the case. The employees have requested that the court issue notice to all potential claimants. The action alleged that those contributions made through December 1996 were being held and not properly used, and sought a return of those funds to the contributors. Former workers of Havens Steel Company reached a preliminary settlement in a lawsuit filed over a dispute of an employee stock ownership plan. The proposed settlement of the class-action suit, which includes about 500 former employees and retirees, canceled a trial that was scheduled to begin early April 2006. A class action lawsuit has been filed on behalf of employees of baby products retailer Baby Daze, Inc., parent company of Baby Tycoon, Inc., which also does business as USA Baby. The suit alleges that the baby supply retailer routinely denied overtime pay to employees who had worked hours in excess of 40 per week. The workers are seeking back overtime pay and other damages. A nationwide class action has been filed in Georgia against publishing giant Primedia, Inc. and its subsidiary Haas Publishing Companies, Inc. The action is brought on behalf of all employees who are beyond the age of 40 and have been either terminated from employment, or forced to resign, as a result of age discrimination. The action is brought under the federal Age Discrimination Employment Act and seeks compensatory and statutory damages as well as injunctive and declaratory relief. A nationwide class action has been filed against parcel delivery giant UPS on behalf of disabled workers. The lawsuit alleges that UPS engaged in company-wide violations of the federal Americans With Disabilities Act. The plaintiffs seek a permanent injunction barring UPS from engaging in discriminatory employment practices and the implementation of policies that provide equal opportunities for disabled workers. |
