Lawsuit Alleges GM Knowingly Concealed Major Engine Flaw That Causes “ Piston Slap”

Several class actions have been filed against General Motors Corporation on behalf of purchasers of 1999 through 2003 model GM vehicles with a 3.1, 3.4, 4.8, 5.3, 5.7 (LS1), 6.0, or 8.1 liter engine that exhibits a loud noise due to piston slap, who allege that GM actively concealed the engine defect while continuing to advertise, market, and warrant that GM engines are free from defects. Some of the models that may have the defect are the Chevrolet Camaro, Corvette, Silverado, Tahoe and Surburban; GM Denali and Yukon; Cadillac Escalade and Pontiac TransAm.

The action alleges that the vehicles that are so noisy they're unbearable to drive and impossible to re-sell.
GM allegedly sold over 800,000 vehicles with the defective engines that rattle and burn gas at an excessive rate because of a design flaw that resulted in "piston slap." Named plaintiff Dan Powell from Orlando, Florida, was so incensed by the knocking on his 2001 Yukon XL sport utility that he created a website www.pistonslap.com, which discusses the engine problem and seeks feedback from others with the issue.

Piston slap is caused by exessive space between the engine's pistons and cylinders. Automotive industry experts claim that the condition wastes fuel and produces significantly higher vehicle emissions due to incomplete combustion, or combustion of excessive amounts of lubricating oil. Higher levels of fuel consumption and vehicle emissions allegedly increase exponentially as the miles increase due to accelerated wear to the internal engine components. The fuel and oil consumption problems on these vehicles allegedly cause them to have levels of emissions that would be expected from a vehicle with 200,000 plus miles.

The parties have reached a tentative $2,346,535 settlement in an action filed against SAFECO Insurance Company of America and numerous affiliated companies on behalf all persons insured by an automobile insurance policy issued in Georgia by the defendants and who made a claim for damage to their vehicles under their collision, comprehensive, underinsured, or uninsured motorist coverage for a loss that occurred between June 19, 1997, and November 28, 2001. Though there is no claims deadline at this time, persons who are eligible to take part in the settlement who have not received a notification letter should act as soon as possible to alert the company of their eligibility.
 
The class has been certified in an action filed against Volkswagen of America, Inc. on behalf of Florida owners of 1999-2002 VW Jettas, who allege that their front end spoilers are poorly designed, so that they catch on parking lot curbs and easily tear off. The action seeks compensatory damages for those owners who have had to pay for repairs, and a remedial fix for those owners who have had no problems. A class action has been filed against Landers Auto Sales, Inc. and related companies on behalf of Landers salespersons in Arkansas, Tennessee, and Mississippi, alleging that the company bilked them of their commissions, unjustly enriching itself by taking keeping money that should have been paid as commissions.
 
A class action has been filed against Shell Oil Company, Motiva Enterprises, LLC, and several other affiliated companies on behalf of persons who purchased sulfur-tainted gasoline from Florida gas stations that were supplied by Shell Oil or Motiva during May 2004. The gasoline causes fuel gauges to stop functioning, and may cause other unknown problems.
 
A federal judge in Oklahoma will soon decide whether to grant class action status to lawsuits that claim General Motors (GM) sold pickups and sport utility vehicles with defective engines, the attorney representing car owners. The lawsuit says that GM produced as many as 800,000 pickups and SUVs between 1999 and 2002 with a noisy defect referred to as piston slap, according to an attorney for the plaintiffs.
 
U.S. District Court Judge Arthur Tarnow granted class action status to a lawsuit filed by Ford UAW retirees. The lawsuit seeks to approve the landmark health care deal that the union and automaker approved by a razor-thin margin late last year. Under the agreement, retired autoworkers would start paying monthly contributions, annual deductibles and co-payments for some medical services up to a maximum of $370 a year for individuals and $752 for a family. Currently these fees are not paid by employees.
