Pennsylvania and New Jersey Residents Furious Over Accredited Collection Agency's Alleged Harassment

A multi-state class action has been brought in Pennsylvania against Accredited Collection Agency, Inc. and attorney Norman G. Kalina. The action is brought on behalf of all Pennsylvania and New Jersey consumers who, since March 16, 2003, have been contacted by Accredited or Kalina in an effort to collect an alleged outstanding debt. The action is brought under the Federal Fair Debt Collection Practices Act and seeks actual and statutory damages as well as injunctive and declaratory relief.

According to consumers, Accredited and Norman Kalina have violated the Fair Debt Collection Practices Act in many ways in their efforts to collect alleged outstanding debts. The consumers claim that Accredited has used Kalina's name and law firm as a shill intended to intimidate consumers into paying their debts by representing that an attorney has reviewed their accounts. According to consumers, letters sent on Kalina's letterhead are not signed by the attorney, and the return address is in fact that of Accredited's offices, not Kalina's. Under the Fair Debt Collection Practices Act, any material misrepresentation made in an effort to collect a debt is strictly forbidden. Additionally, consumers allege that at no time did Accredited or Kalina inform them of their right under the act to dispute the validity of the debt under collection within 30 days of initial communication. Under the act, this information must be provided either in the initial communication, or within five days of the initial communication. Furthermore, the consumers claim that Accredited used intimidating and harassing tactics in an effort to collect alleged debts. The consumers allege that Accredited made repeated phone calls to them at their places of business and threatened to garnish their wages and to speak to their co-workers and supervisors. The consumers claim that these calls were made even after a specific request was made by consumers to cease these calls. Under the act, any use of intimidation, threats or coercion is strictly forbidden.
The consumers claim that the actions of Accredited satisfy this standard and entitle them to damages.

A state wide class action has been filed in Pennsylvania against collection specialists, Bronson & Migliaccio, LLP. The action is brought on behalf of all Pennsylvania consumers who, since January 30, 2003, have received a "form type" collection letter from Bronson & Migliaccio. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
A national class action has been filed in New York against collection specialist, Maximus, Inc. The action is brought on behalf of all U.S. residents who received a collection letter from Maximus which demanded payment within 30 days. Consumers claim this demand has the effect of overshadowing the statutorily required statement entitling consumers to challenge the validity of the alleged debt. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
The parties have reached a $1.6 million settlement in an action filed against Ameriquest Mortgage Company, on behalf of all persons who obtained Ameriquest, Argent Mortgage Company, Town & Country Credit Corporation; or Olympus Mortgage Company variable rate loans between June 1, 1998, and June 30, 2003, which were secured by real properties in the State of California, and who paid a prepayment charge in excess of that permitted by the California Civil Code. Persons with outstanding loans, who might still be subject to prepayment charges from these companies should also submit claim forms. Claim forms must be postmarked no later than November 19, 2004, to be considered valid.

A class action has been filed against Denver-based loan-buyout company EquityLink, LLC, on behalf of Colorado homeowners who allege that the company's "HomeSaver" program is actually deceptive and highly predatory, and violates state lending laws.
 
A national class action has been filed against New York City's Interfaith Medical Center on behalf of all consumers who have received, since November 6, 2002, a collection letter from either South Side Collection, Inc. or National Revenue, Ltd in an attempt to collect a debt for Interfaith. The consumers allege that these letters are actually generated by Interfaith itself and therefore violate the federal Fair Debt Collection Practices Act. Consumers are seeking actual damages, statutory damages, and injunctive and declaratory relief.
 
On June 20, 2003, the court granted final approval to the parties' settlement of a class action against First Union Mortgage Company on behalf of persons who had a mortgage loan serviced by First Union as of April 1, 1998, and paid a $1 monthly fee for the receipt of a monthly mortgage statement to either First Union or Alliance Mortgage Company between April 1, 1998, and November 1, 2002. Claims must be received by July 8, 2003.
