Connecticut Consumers Claim Peter Roberts & Associates Sought Illegal Collection Fees

A statewide class action has been filed in Connecticut against collection specialist, Peter Roberts and Associates, Inc. The action is brought on behalf of all Connecticut residents from whom Roberts attempted to collect allegedly illegal collection fees in connection with an attempt to collect an outstanding debt other than a student loan. The action is brought under the federal Fair Debt Collection Practices Act and is based upon Connecticut consumer laws. The consumers are seeking compensatory damages as well as injunctive and declaratory relief.

According to consumers, Roberts has been charging fees in excess of the legal limit during collection attempts. The consumers allege that Roberts charges fees in excess of 15% of the total value of the debt under collection. This, according to consumers violates Connecticut state law and the Fair Debt Collection Practices Act. In addition, consumers allege that Roberts does not itemize collection statements, misleading and deceiving consumers by not providing an accurate accounting of the original debt, fees and interest. Consumers allege that this is a longstanding tradition of Roberts' and that the potential class is quite numerous as a result.

A class action has been filed in Maryland against Ocwen Federal Bank FSB on behalf of all mortgage borrowers who, since October 23, 1991, have been charged allegedly unlawful inspection fees by Ocwen. Consumers allege that Ocwen has violated state consumer debt collection and commercial laws and has breached its contract with consumers. Consumers are seeking compensatory, statutory and punitive damages, declaratory relief and a permanent injunction and the disgorgement of funds obtained through unjust enrichment.
 
A national class action has been filed in Kansas against mortgage broker giant, Money Tree Mortgage, Inc. The action is brought on behalf of all U.S. residents who have applied for mortgages through Money Tree and alleges that the company has committed a litany of common law and federal violations from fraud, conversion and negligent misrepresentation to wire fraud, racketeering and violations of the Equal Credit Opportunity Act. The action seeks compensatory, statutory and punitive damages as well as injunctive and declaratory relief.
 
A statewide class action has been filed in California against collection specialist, ARS National Services, Inc., who operate as Associated Recovery Systems. The action is brought on behalf of all California residents who received a collection letter from Associated which offered to settle the debt for a lesser amount, if payment was made immediately. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.
 
A class action lawsuit has been filed on behalf of Maryland residents who were charged a $5 fee in order to cash a paycheck issued by Bank of America NA at one of the bank's branches. The lawsuit contends that the bank's issuance of this fee is unfair and that the bank is deceitful in its failure to disclose the fee or to advise consumers as to how to avoid the fee. The lawsuit seeks a refund of the check cashing fees and other damages.
