African Americans Request Class Certification in Discrimination Action Against Union Pacific Railroad Company |

A class action has been filed against Union Pacific Railroad Company on behalf of African Americans applied for a job between July 18, 2000, and the present. The action alleges that the railroad's hiring policies, practices, and procedures for jobs not governed by a collective bargaining agreement allow discrimination. The action seeks unspecified compensatory and punitive damages.
Named plaintiff Karen Yapp and others allege systemic racial discrimination by the railroad. On August 29, 2003, they requested certification of a class of all African Americans adversely impacted by the railroad's policies, practices, and procedures relating to hiring for jobs not governed by a collective bargaining agreement at any time during the applicable period.
Union Pacific is also currently being sued on behalf of female applicants for jobs in an action that alleges discrimination based on gender.

The employees have requested that the court issue notice to all potential claimants. A class action lawsuit has been filed on behalf of employees of insurance carrier Pilot Catastrophe Services, Inc. The suit alleges that the catastrophic risk insurer routinely denied overtime pay to employees who had worked hours in excess of 40 per week. The workers are seeking back overtime pay and other damages.
Orange County Sheriff Kevin Beary faces a class-action lawsuit filed by agency retirees angered by losing lifetime health insurance benefits. About 300 former employees claim Beary illegally stripped them of the coverage offered since 1998 to anyone who worked 20 years or more for the agency.
A nationwide class/collective action has been filed in California against truck stop Giant, Pilot Travel Centers, LLC and its parent company, Pilot Corporation. The action is brought on behalf of all general managers, co-managers, operations managers, sales managers, guest service managers, and human resource managers who since December 11, 1999, in California and December 11, 2000, nationwide were denied overtime compensation by Pilot. The action is brought both under the federal Fair Labor Standards Act and the California labor and business professions codes and seeks back pay, liquidated damages and statutory penalties as well as declaratory and injunctive relief. The action is both a class action, for violations of California law, and a collective action under the federal Fair Labor Standards Act. Those residing outside of California who wish to be considered for the action must "opt-in" voluntarily to be considered a claimant. The managers have requested the court give notice to all potential claimants. A statewide collective action has been filed in Florida against Flood Zone Correction, Inc. The action is brought on behalf of all current and former employees, who since April 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
