Several class actions have been filed against mutual fund companies Allianz Dresdner Asset Management of America, LP and PIMCO Advisors Distributors, LLC by investors who purchased any shares of a number of PIMCO funds between February 23, 1999, and February 17, 2004. The actions claim that the defendants violated federal securities laws by allowing certain favored investors to time their trades to the detriment of the investing public. The investors seek to recover compensatory damages for the loss of value of their stock.
The funds that are the subject of this suit and their symbols are as follows: The action names as defendants Allianz Dresdner Asset Management of America L.P., PIMCO Advisors Distributors LLC, Pacific Investment Management Company LLC, PEA Capital LLC, Pacific Company LLC, Edward J. Stern, Canary Capital Partners, LLC, Canary Investment Management, LLC and Canary Capital Partners, Ltd. of The action alleges that the defendants surreptitiously permitted certain favored investors, including Canary, to illegally engage in "market timing" of the PIMCO Mutual Funds whereby these favored investors were permitted to conduct short-term, "in and out" trading of mutual fund shares, despite explicit restrictions on such activity in the PIMCO Mutual Funds' prospectuses. If you purchased PIMCO mutual fund shares during the applicable period, you may request appointment by the court as a lead plaintiff if you do so by April 20, 2004. (NasdaqNM:BCSI), certain of its officers and directors by stockholders who purchased the company's common stock between February 20, 2004 and May 27, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The stockholders seek to recover compensatory damages for the loss of value of their stock. A class action has been filed against Carrier Access Corporation (NasdaqNM:CACSE) formerly (NasdaqNM:CACS), certain of its officers and directors by stockholders who purchased the company's common stock between October 21, 2003 and May 20, 2005. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The stockholders seek to recover compensatory damages for the loss of value of their stock. A class action has been filed against Sharper Image Corporation (NasdaqNM:SHRP), certain of its officers and directors by stockholders who purchased the company's common stock between February 05, 2004 and August 04, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The stockholders seek to recover compensatory damages for the loss of value of their stock. Several class actions have been filed against biopharmaceutical research company Allos Therapeutics, Inc., (Nasdaq:ALTH) and certain of its officers and directors by stockholders who purchased the company's common stock between April 23, 2003, and April 29, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. |
