Big Lots Settles California Manager Overtime Action for $10 Million

The parties have reached a tentative $10 million settlement in a California class action filed against Big Lots, Inc. on behalf of current and former store managers who allege that the company did not compensate them properly for working overtime, in violation of state labor laws. The store managers alleged that Big Lots unfairly exempted them from overtime eligibility when they were required to perform clerical and other duties. Under state laws, workers classified as managers are eligible for overtime pay at time-and-a-half if they spend more than half their time performing non-supervisory work. The Big Lots case was originally several cases, some filed against other discount retailers—such as Pic ‘N’ Save and MacFrugal’s Bargains CloseOuts—later acquired by Big Lots. The cases, filed in 2000 and 2002, were combined into one class-action suit.

A national class action has been filed in Nebraska against the Union Pacific Railroad Company. The action is brought on behalf of all female employees who have either used prescription contraceptives or who would have used them if they were covered by Union Pacific's employee health insurance policy. The employees allege that the exclusion of prescription contraceptives from the employee health insurance package is discriminatory and equals a violation of the federal Civil Rights Act and the Pregnancy Discrimination Act.
 
Brinker International Inc., operator of the Chili's and Romano's Macaroni Grill restaurant chains, face a class-action lawsuit claiming that the company violated California law mandating workers' meal and rest breaks.
 
A class action lawsuit has been filed in the Southern District Court of Texas against Smart Cars of Houston, Inc. The case involves violations of the Fair Labor Standards Act which establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in Federal, State, and local governments. A collection action has been filed against the Puerto Rico Federal Affairs Administration and several of its employees on behalf of all employees of the administration who were not paid overtime compensation or minimum wage or were wrongly terminated after complaining to the administration about these payment discrepancies. The action is brought under the federal Fair Labor Standards Act and is seeking unpaid wages, statutory damages, and declaratory relief.
