Pennsylvania Consumers Target Bronson & Migliaccio for Unfair Collection Attempts

A state wide class action has been filed in Pennsylvania against collection specialits, Bronson & Migliaccio, LLP. The action is brought on behalf of all Pennsylvania consumers who, since January 30, 2003, have received a "form type" collection letter from Bronson & Migliaccio. The action is brought under the federal Fair Debt Collection Practices Act and seeks statutory damages as well as injunctive and declaratory relief.

According to consumers, the "form type" collection letters sent by Bronson & Migliaccio violate the federal Fair Debt Collection Practices Act. Consumers allege that they violate the act for two reasons. Initially, the consumers claim the letters are illegal because they represent to consumers that they originate from an attorney's office, and have been reviewed by an attorney. Secondly, the consumers assert that the letters inform recipients that they are required to inform Bronson & Migliaccio in writing if they wish not to be contacted further by phone or letter at their home or place of business. The consumers allege that under the Fair Debt Collection Practices Act, any communication containing untrue, misleading or coercive claims is unlawful. The consumers assert that Bronson & Migliaccio's representations run afoul of this standard. The consumers allege that no attorney has, in fact, reviewed their debt. They claim that these letters are mass generated and besides entering their information into a computer, very little human involvement has occurred with these collection attempts. Additionally, the consumers allege that requiring them to contact Bronson & Migliaccio in writing to suspend further communications at their place of business is coercive because it amounts to a tacit threat to contact their employers regarding their alleged debt. The consumers claim that Bronson & Migliaccio have sent hundreds, and most likely thousands, of these letters and that, as a result, the class is quite numerous.

Several class actions have been filed against financial services company Washington Mutual, Inc., (NYSE: WM) and certain of its officers and directors by stockholders who purchased the company's common stock between April 15, 2003, and June 28, 2004. The actions claim that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities.
 
Collection agencies are regulated by state and federal laws to ensure that they only use methods that are fair and above-board. A class action has been filed against DBS Collection Agency of Zanesville, Ohio, on behalf of all persons who were sued by the company in collection lawsuits between August 1998 and March 2001, alleging that the company committed mail and wire fraud and violated consumers' constitutional rights, the federal Fair Debt Collection Practices Act and Ohio's Consumer Sales Practices Act.

On November 22, 2004 the court granted final approval to the settlement agreement submitted by the parties in a class action that had been filed against Fleet Bank (R.I.), N.A. on behalf consumers who alleged that the credit card issuer mislead them by promising a "fixed" low interest rate on its credit cards and then raising the rate just one year later in violation of state unfair trade practices laws and the federal Truth in Lending Act. The action sought unspecified compensatory and punitive damages.
 
A class action lawsuit has been filed on behalf of debtors of the American Arbitration and Recovery Group, LLC. The suit alleges that Affiliated failed to adhere to the requirements of the federal fair debt collection practices act in its interactions with debtors. Additional details are not available at this time but will be reported once they become known.
