Non-Sprint Customers Claim Sprint Charges Them Unauthorized Fees

A national class action has been filed in Illinois against Sprint Communications Company, L.P. The action is brought on behalf of all U.S. residents, who are not Sprint customers, but who have had unauthorized charges added to their phone service by Sprint. The action is brought under the federal Communications Act and federal common law and seeks disgorgement of profits, penalties, compensatory damages and injunctive and declaratory relief.

According to consumers, Sprint has added charges to their local telephone service that were not authorized. The consumers are not customers of Sprint, yet Sprint has allegedly added charges to their phone bills for Carrier Universal Service, Single Bill fees, Carrier Cost recovery, State TIF and federal, state and local taxes. When confronted with these allegedly unauthorized charges, the consumers claim that Sprint has been less than helpful and has only offered to refund a small portion of the charges. Under both the federal Communications Act and federal common law, Sprint has a duty to not engage in unfair, unjust or unreasonable practices. The federal Communications Act authorizes persons injured by such conduct to file a claim in federal court to recover damages as well as file a complaint with the Federal Communications Commission. Similar remedies are available under federal common law. The consumers claim that Sprint's conduct is unfair, unjust and unreasonable, entitling them to damages. The consumers further assert that Sprint's conduct is widespread and that the potential class numbers in the thousands, if not hundreds of thousands.

A national class action has been filed in Florida against wireless service giant, Sprint PCS. The action is brought on behalf of all U.S. residents who have either been charged an early termination fee for canceling their Sprint PCS service, or who have been forced to maintain their Sprint PCS service in order to avoid early termination fees. The Sprint users allege that Sprint has breached its contract with customers by not providing adequate service and by not investigating problems with service sufficiently. The action is brought under state contract law and state laws regulating unfair and deceptive business practices and seeks compensatory and punitive damages as well as disgorgement of profits and injunctive and declaratory relief.
 
A statewide class action has been filed in Florida against mortgage service specialist, Green Tree Servicing, LLC. The action is brought on behalf of all Florida residents whose mortgage was transferred to Green Tree for servicing and who did not receive a notice of transfer within the federally mandated 15 day period. The action is brought under the federal Real Estate Settlement Procedures Act and seeks a minimum of $1000 in statutory damages per class member as well as compensatory damages where appropriate.
 
A class action has been filed in the Southern District Court of New York against Royal Group Technologies, Ltd, (NYSE: RYG) a global manufacturer of polymer-based home improvement, consumer and construction products, and certain of its officers and directors by stockholders who purchased the company's common stock between February 11, 2004 and October 13, 2004. The action claims that the defendants violated federal securities laws by issuing a series of material misrepresentations to the market over this time period, thereby artificially inflating the price of the company's securities. The stockholders seek to recover compensatory damages for the loss of value of their stock.
 
Pennsylvania law protects its residents from companies that use unscrupulous billing practices. The parties have reached a settlement in an enforcement action filed against national lawncare business Trugreen Chemlawn on behalf of more than 121,000 Pennsylvanians who paid an undisclosed fuel surcharge when they hired the company to perform various lawn care services between July 13 and December 31, 2000. Eligible participants should contact the Pennsylvania Attorney General's office for details.
 
Notebook computers are supposed to increase productivity, not reduce it. A nationwide class action has been filed against computer giant Hewlett-Packard, Inc. on behalf of purchasers of Pavilion Notebook computers who allege that the LCD displays in their computers are inherently defective, and that the company has taken no action to remedy the problem.
