Major Department Stores and Cosmetic Manufacturers Settle Price-Fixing Action for $175 Million

On March 30, 2005 the court granted final approval for a $175 million settlement in an action filed against major department stores and cosmetic makers on behalf of U.S. residents who purchased certain cosmetics and fragrances from the defendant department stores between May 29, 1994, and July 16, 2003. The action alleged that the stores and manufacturers conspired together to fix prices in violation of federal antitrust laws. Claims must be postmarked on or before March 26, 2004, to be considered valid.

This lawsuit involves products which are the full range of high-end, "prestige" or specialty beauty and cosmetic products and product lines, including color products such as foundation, eye shadow and lipstick; treatments such as skin creams and moisturizers; and fragrances, and which are sold primarily through department or specialty stores. The settlement does not include cosmetics and fragrance products sold through mass distribution channels, such as drug stores and warehouse outlets.

If you purchased certain branded cosmetics (listed below) from any of the following stores during the period, you are a member of the class: Dillard's, Inc., Federated Department Stores, Inc., Gottschalks Inc., The May Department Stores Company, The Neiman Marcus Group, Inc., Nordstrom, Inc., Saks Incorporated and Target Corporation.

The stores that are included have various names:

The following cosmetic and fragrance manufacturers were named in the action: Boucheron (USA), Ltd., Chanel, Inc., Christian Dior Perfumes, Inc., Clarins U.S.A., Inc., Conopco, Inc., The Estée Lauder Companies Inc., Guerlain, Inc., L'Oréal USA, Inc. (formerly known as Cosmair, Inc.) and Parfums Givenchy, Inc.

If you bought the following brand name products from one or more of the named stores during the applicable period, you may make a claim under the settlement:

The settlement will provide each class member with cosmetic or fragrance products with an approximate retail value of $18 to $25 per person. If you are a class member and wish to make a claim, you should register on the settlement website by using the link there to leave your email address or mailing address. You may also call 1-877-604-5776 and leave your name and mailing address. If you do so, upon approval of the settlement, you will be notified by email or postcard as to when the free products will be made available.

Florence Cohen says she bought the video game Grand Theft Auto: San Andreas for her 14-year-old grandson without knowing it contained hidden, sexually explicit scenes at a time when the controversial game was rated M (Mature), for gamers 17 years and over. Her suit is reported to be "on behalf of consumers nationwide".
 
When you are charged a late fee, the fee generally has to be related to the amounts that the company has to spend collecting your payment. The class has been certified in an action filed against Cox Communications of New Orleans, Inc. on behalf of all current and former residential subscribers of Cox cable television service in Orleans, Jefferson, St. Charles, and St. Bernard Parishes who have been assessed or who have paid a late fee to Cox in connection with their cable television service. Class members do not need to take any action at the present time to remain eligible.
 
A class action has been filed against Leviton Manufacturing Company, Inc. on behalf of South Carolina residents whose homes have an allegedly unsafe type of electrical outlet--a back plug-in outlet--manufactured by Leviton in violation of state consumer safety laws. The action seeks unspecified compensatory damages.
 
At least 1,000 Washington homeowners paid higher mortgage rates than they had to without getting proper notification, according to a lawsuit that a federal judge certified for class-action status.
 
A class action lawsuit has been filed in the Eastern District Court of Missouri against Bank of America for violations of banking law. Class members seek damages, injunctive relief, attorney's fees and costs of the litigation.
