Florida Employees of American Coach Lines Drive for Overtime Compensation

A statewide collective action has been filed in Florida against American Coach Lines of Orlando, Inc. The action is brought on behalf of all current and former employees who have not been paid proper overtime compensation for all hours worked in excess of 40 per week. The action is brought under the Federal Fair Labor Standards Act and seeks back pay, liquidated damages and injunctive and declaratory relief. As a collective action all potential claimants must voluntarily "opt-in" to the case in order to be considered a member of the class. The employees have requested that the court issue notice to all potential claimants.

According to employees American Coach Lines has a long standing company policy of denying hourly employees overtime compensation for hours worked beyond 40 per week. Under the Fair Labor Standards Act, all "non-exempt" employees are entitled to overtime compensation at the rate of time and a half for all hours worked in excess of 40 per week. "Non-exempt" employees are generally those that work on an hourly basis and do not perform managerial or executive tasks. The employees claim that they are "non-exempt", paid hourly and thus are entitled to overtime compensation under the Act. Additionally, the employees claim that because American Coach's failure to pay overtime was willful and intentional, they are entitled to liquidated damages.

A national class action has been filed against prescription drug plan operator Express Scripts, Inc. on behalf of all U.S. citizens who were or are participants in or beneficiaries of any employer-provided prescription benefit plan (1) that required participants or beneficiaries to pay a percentage co-pay for prescription drugs and (2) for which Express Scripts, Inc. or one of its predecessors-in-interest or subsidiaries serves or has served as the plan's provider of prescription drugs at any time from October 1, 1997, through the present. The action is brought under the Employee Retirement Income Security Act (ERISA) and claims that Express Scripts breached its fiduciary duty to plan participants and beneficiaries in several ways. The participants are seeking declaratory and injunctive relief and a court order requiring Express Scripts to make an accounting of and reimburse consumers and benefit plans all monies earned through allegedly unlawful activities.
 
Verizon Communications will pay almost $49 million to 12,326 past and present women employees as part of a settlement of a government suit claiming the company discriminated against pregnant women. The U.S. Equal Employment Opportunity Commission reached the settlement in 2002 after accusing Verizon's predecessors, Nynex Corp. and Bell Atlantic, of denying expectant mothers full pension benefits.

As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The managers have requested that the court issue notice to all potential class members.
