Oregon Employees of Eastmoreland Hospital Target Symphony Healthcare

A statewide class action has been filed in Oregon against Symphony Healthcare, Inc., the former owner and operator of Eastmoreland Hospital. The action is brought on behalf of all former employees of Eastmoreland who were terminated on January 16, 2004, when Symphony suddenly closed Eastmoreland without any prior notice to the employees. The action is brought under the federal Worker Adjustment and Retraining Act (WARN) and seeks back pay and benefits for all former employees.

According to the employees, on January 16, 2004, Symphony closed, without any advance warning, Eastmoreland Hospital in Portland, Oregon. The employees claim that this closure violated the federal WARN act. Specifically, the employees claim the closure constitutes a plant closing under the act. The employees allege that under the WARN act, they were entitled to 60 days advance notice of the closing of the hospital, notice that they claim was not provided by Symphony. Although under some circumstances, the WARN act allows for a shortened notice period, the employees claim that they received no notice and that this action was not practicable under the circumstances. According the class action complaint, the class is composed of roughly 275 potential claimants. The employees have requested that the court issue notice to all potential members.

A class action lawsuit has been filed in the Southern District Court of Florida against Bicon, Inc. (DBA S&S National Waste). The case involves violations of the Fair Labor Standards Act. A statewide collective action has been filed in Florida against Kilowatt Electric Company. The action is brought on behalf of all current and former laborers, who since May 2001, were not paid proper statutory overtime for all hours worked beyond 40 per week. The action is brought under the federal Fair Labor Standards Act and seeks statutory and liquidated damages as well as declaratory and injunctive relief. As a collective action, all potential claimants are required to "opt-in" to the action in order to be considered part of the class. The employees have requested that the court issue notice to all potential class members.
 
A class action lawsuit has been filed in U.S. District Court for the Northern District of Oklahoma against Star Care, Inc. The case involves violations of Federal Labor law. A class action lawsuit was filed against Tata America, a subsidiary of the Tata Group, claiming the company routinely forced workers to hand over federal and state tax refunds. Gopi Vedachalam, a Tata America employee, filed the lawsuit in the District Court in San Francisco against Tata America International Corporation, its parent Tata Consultancy Services Ltd, as well as Tata Sons, Ltd.
