Report Fraud
Case ID: 3083 | Insurance | 12/27/2004

The parties have reached a settlement apparently valued at $5,850,000 in an action filed against the Insurance of America Agency, Inc., the National Business Association, Inc., the American National Insurance Company, Inc., and the American National Life Insurance Company of Texas on behalf of all persons (1) who obtained certificates of insurance from American National Life Insurance Company of Texas, Inc., or American National Insurance Company, that were the subject of a trust agreement in which those companies were the administrators for the National Business Association insurance program after October 12, 1996, or (2) who were over eighteen as of July 1, 2003, and were insured under certificates containing a co-pay and wellness benefit rider offered by American National Life Insurance Company of Texas when notices issued in their state of residence that the rider was to be deleted. Persons who have not received notification, but are eligible to take part in the action should contact class counsel as soon as possible.

American National Life Insurance Company of Texas and American National Insurance Company will provide those members of both classes $40 wellness benefits per year for 2004, 2005 and 2006 to be exercised on or before October 31st of each of those years. Claims must be filed by November 15th of each of those years to be considered valid. Individuals who only fall into one of the two classes will receive three $30 wellness benefit certificates subject to the same terms. “Wellness benefit” means a reimbursement for up to the certificate amount for charges incurred by the certificate holder for routine physical exams and polio, DPT and MMR immunizations, HIB vaccinations, diphtheria and tetanus boosters, vaccinations for flu and pneumonia, and TB skin tests. The wellness benefits will be payable in addition to any other insurance coverage. They will not be assignable, and they will be evidenced by three numbered certificates, which are redeemable by complying with the claims procedures indicated on those certificates.

Additionally, also in exchange for dismissing the lawsuit and releasing the claims made in that suit,
the National Business Association will discount the dues of class members by $3 per month for 12 months. Likewise, any class member who chooses to join the National Business Association may take advantage of the same discount.

The judgment was finalized at a hearing held on January 8, 2004.

Recent research has suggested that the “insurance crisis” is little more than a ruse to allow insurers to hike your premiums. A nationwide class has been certified in an action filed against St. Paul Fire and Marine Insurance Company and its affiliate, Commercial Insurance Service, Inc., on behalf of physicians who allege that the companies withdrew their malpractice coverage, breaking their contracts and cheating them of tail coverage that goes into effect when a doctor retires, is disabled, or dies.

A class action has been filed against seven insurance companies on behalf of residents of Maryland, North Carolina, Virginia, West Virginia, Delaware, New Jersey and the District of Columbia, who held flood insurance policies and suffered damage to their houses in September 2003 from Hurricane Isabel. The parties have reached a tentative multimillion dollar settlement in an action filed against United Parcel Service, Inc. on behalf persons who bought "excess value" package insurance from UPS going as far back as 1984.
