A collective action has been filed in Florida against WHB Parking Systems, Inc and USA Parking System. The action is brought on behalf of all Florida employees of WHB who have not been paid proper minimum wage or who have had wages due to them withheld by the company. The action is brought under the federal Fair Labor Standards Act and seeks back pay, statutory and liquidated damages as well as injunctive and declaratory relief. As a collective action all potential claimants must "opt-in" in order to be a member of the class. The employees have requested that notice be sent to all potential claimants.
This action arises from what employees claim is a willful and intentional course of action on the part of WHB Parking Systems. According to the employees, WHB has not paid them proper minimum wage compensation as required by the federal Fair Labor Standards Act. The employees allege that during slow periods, wages are often withheld. Also, according to the employees, compensation for the first week of employment is typically withheld by the company as well. Under the Fair Labor Standards Act, all hourly employees are entitled to a minimum of $5.15 per hour and this payment is to be "promptly made" under the act. The employees further allege that in the event that a complaint is made to management regarding outstanding wages, WHB often terminates the employee, further violating the Fair Labor Standards Act.

of all former and current employees who have worked in excess of 40 hours a week, but who have not been paid overtime by the school district. The action is brought under the federal Fair Labor Standards Act and is seeking back pay as damages.
