Florida Equity Residential Apartment Tenants Certified as Class in Illegal Charges Suit |

The class has been certified in a Florida action filed against the Equity Residential Properties Trust and affiliated organizations on behalf of all Equity Residential Florida apartment tenants and their co-signers who moved or left their Equity Residential Florida apartment from December 1, 1998, to present, who signed an Equity form lease and who received a demand for fees resulting from “insufficient notice,” “early termination,” “cancellation,” “lease fulfillment,” “no notice given,” or “liquidated damages.” The action alleges that the businesses violated the Florida Residential Landlord Tenant Act, the Florida Consumer Collection Practices Act, and the Florida Deceptive and Unfair Trade Practices Act. The action seeks unspecified compensatory and punitive damages.
The action will affect more than 10,000 Florida tenants who have leased from Equity since December 1998 and were allegedly overcharged an average of $1,372 per apartment. The action alleges that the overcharges total $14.5 million. Persons eligible to take part in the action should contact the class attorneys for more information.

A class action has been filed on behalf of students of Native American descent in the Perry township school system. Persons with outstanding loans, who might still be subject to prepayment charges from these companies should also submit claim forms. Claim forms must be postmarked no later than November 19, 2004, to be considered valid. Class-action status is being sought in a lawsuit alleging sexual abuse over a 50 year period at a Roman Catholic orphanage in Jefferson County, Kentucky. The suit was filed by Kentucky lawyers in 2004. The suit was filed against the Sisters of Charity of Nazareth and the Archdiocese of Louisville's Catholic Charities. The case alleges sexual abuse and other physical abuse over a 50 year period, primarily at three Kentucky orphanages.
A class action has been filed against Thermal Ease Hydronic Systems, Inc., its parent company Plasco Manufacturing Ltd. (now known as Uponor Canada, Inc.), and other firms on behalf of all people in the United States who now own, or owned in the past, buildings in which a hydronic heating system using cross-linked non-barrier polyethylene pipe manufactured by Thermal Ease was installed on or after January 1, 1995. This pipe, known as UltraPEX, allegedly deteriorates over time as a result of being exposed to regular tap water, which contains chemicals such as chlorine.

The parties have reached a tentative settlement in a class action filed against Smith Property Holdings Harbour House South L.L.C. on behalf of residents who lived in Harbour House South, a 452-unit residential apartment building at 10275 Collins Avenue, Bal Harbour, Florida, and suffered due to a renovation of the building between November 1, 2000, and January 9, 2003. Claims must be on file by March 14, 2004, to be considered valid.
Ground water contamination by industrial waste is a topic of growing concern these days. The class has been certified in an action filed against Conoco, Inc., Agrico Chemical Company, and Escambia Treating Company, Inc., on behalf of all persons who own or owned real property in Pensacola, Florida between 1957 and the present. Though persons who are eligible to participate in the action need do nothing at the present time to maintain their status, they should contact class counsel to assure that they are registered.
